    If you didn't do it, you didn't do it.
    You remained for long enough for him to obtain details - i take it you didn't speed off when asked for a name?

    Stick to what you know: you didn't collide with his car, you have no idea what he is talking about, and ask him to provide evidence.

    In future: If someone makes any allegation, take photos, get witness details, get their details, ask if anyone is injured, and ask for full details (include dob) for anyone in the car at the time. If in doubt call the police.

    I certainly didn't speed off - probably sat in my car for a good 10 mins. Will definately heed advice in future, will have to ask Santa for a camera phone (& keep it fully charged)!!

    What happened was............had parked up in a space ready to collect my DS from club, when suddenly, a chap appeared in front of my car & started looking closely at the front. I got out of my car to ask him what the problem was, & he accused me of hitting his car whilst parking!
    He may have found damage to his car on a previous day and, assuming you park there regularly, decided that your car had done it. The damage on your car reinforced his assumption.

    Why will the OP be in for a rough ride?

    All that has happened so far is that the other party has made allegations to the police and they have contacted the OP and notified him of the possibility that he has committed these offences. The OP will need to contact the police and advise them that no accident/collision took place and that he is not guilty of any offences.

    The issue will hinge on available witnesses. If the other party produces a family member they will not be regarded as independent. In the absence of independent witnesses this has "no further action" written all over it.

    Assuming you've been issued a S172 request, you have 28 days in which to name the driver. At this time, it's probably better to simply return the form and not make any kind of comment about the offence(s) alleged.

  • Wife picked up DS last night, and also took her camera to take some piccies of the alleged damage - she says that there was nothing that looked 'new'?! (no CCTV unfortunately)
    It was obvously dark, and she intends on going back during day-light hours to have another look.
    I now think that rather than trying to defraud the insurance, he thinks he has got the better of me now, as I stood up for myself the other week, and the CHAV didn't like that at all. I guess he's just trying to scare me by going to the police - feel a lot better now.

    I agree. At this stage, the OP should not offer himself up for interview, or even make any comment at this stage.

    I just feel that by NOT making a comment, the police would see that as an admission of guilt, I know I certainly would?
    I welcome the police to come & look at my car, I want to get my say, I want the police to then charge him for wasting their time & resources.

    Can't help with the 2nd but the 1st 1 is what should matter anyway. I can't really help with that either, either you hit him or you didn't, fess up or fight the bloke. Down to you, ;)
