Letter from Police re non-existent accident!

Am totally peed off today after having received a letter from local constabulary accusing me of 'driving without due care & attention', Failing to stop at road traffic accident' & 'failing to report road traffic accident'.

What happened was............had parked up in a space ready to collect my DS from club, when suddenly, a chap appeared in front of my car & started looking closely at the front. I got out of my car to ask him what the problem was, & he accused me of hitting his car whilst parking!

I denied this, at which point he went into his house, got his OH out & started taking pictures of my car!

When I asked him to point out the damage to his car, he started to get mouthy, at which point I told him to call the police.

He then went back into his house.

I now have this letter - now obviously, I shall be writing back to refute this allegation, but, although there was no damage to his car, I do have some minor scratches on mine, which rather annoyingly happened about 1 month after getting my first ever brand new car - I was gutted, but, as the damage was sort of underneath the corner bumper, it isn't too noticeable & have never bothered to get it fixed.

I am going to invite the police round (do they do that?) to inspect my car, will they be able to tell that this pre-existing scratch is 1 year old?

I am absolutely gobsmacked to get this letter, my OH has to pick DS up later today & is talking about taking a camera herself to take piccies of his car - is this a good idea?

Help please

why didnt you call the police?? why ask him to?

hey MR call the cops on yourself for being verbally abusive and trying to defraud my insurance company! hell no he not going to do that is he. 99.9% of the uk have mobiles why didnt you call them? looking around for witnesses to this guy randomly accusing you of hitting his car?

he probably has got damage to his car he did with his foot now so low down it consists with the scuff on your bumper (he was scoping your cars damage to work out where he needed to plant the boot in his) no police wont get involved with this civil matter, the fact you were reported for driving off, and his 20 whitnesses to the accident all adding up to you hitting it getting out having a go then driving off consists to leaving a scene of an accident and driving without due care and attention wich is a police matter as its a mototring offence.

you left yourself wide open not contacting the police there and then where there was whitnesses (if any) to back you up.

here we have a whiplash claim for £1950 that your insurer will not squabble about in paying out now as costs to defend it will be greater if they went to court.

you need to get yourself into the police station, and despute the mototring offences, and then report him for attempting to defraud, that should put a halt on things for a few days, you will then need to go to a insurer approved body shop, and get their optinion the car has never been repainted or involved in any accident, and the scuff you have is consistant to what you say happened a year ago, hope there was some sort of cctv facing your way from the "club" your DS was at that can disprove his story take it the police and let them handle the rest.
  • Unfortunately, I did not have my mobile with me, typically had left phone at home on charge.
There was definately no witnesses around at the time of us arguing.
His car was parked up & there was no-one in it
Hadn't considered CCTV, but I very much doubt that there is - OH on pick up duty tonight so she will have a look out.
Should she take piccies of his car, or would that be pointless now?

His car was parked up & there was no-one in it I bet there will be.

Should she take piccies of his car, or would that be pointless now? Only if there's no damage.
Think you're in for a rough ride.
Careful what you say to the police. Those offences are a large fine and points.

it entirtely up to you where you take pictures in public (within reason and what of).;)

where is he claimit the damage to his car is?

hey may have shot himself in the foot already if your damage is more or less under the lip of the bottom of the bumper and his is in the middle of his bumpers or panels.

Problem was, incident was 10 at night, in the dark, his car appeared to be a bit battered & bruised all over anyway. My damage is well under the bumper, the kind you get when driving over a large rock with a low placed bumper! (don't ask)

Just write back and deny the claims and clearly account for the incident, stick to the facts, no more. I can't see anything coming of this without any proof.

Thanks, I have just compiled a letter in response, and offering for the police to come & inspect my car at any time or to direct me to a garage of their choosing.
Can't believe that this wanXer has made this allegation. There are some absolute low-lifes out there, out to make a buck from the honest ones amongst us:mad:

Been there.. i got a letter from direct line asking me for my details for an "accident" i was involved in a local asda supermarket even tho i was no where near the place at the time.. (got this about 6 weeks back now)
i was actually parked outside NFU's office equiring about a change in vehicle and my car was insight the whole time by cctv in the office aswell as to the advisors.. NFU fired off a foxtrot oscar letter it wasnt our policy holder matey boy. i went to the police aswell..
Heard nothing back and NFU assured me nothing would be paid out as it was clearly not me..
thing was theres 3 xsara's in the surrounding area in the exact same colour as mine..

You need to report this to the police asap... but i think id of lost any claim against me if i wasnt in the insurers offices that day at the time i was alledged to have hit the TP..

With any luck, he'll have tried this several times before on other motorists and he'll get into some deep poo for insurance fraud.

If you get convicted for those 2 offences, and the idiot who knocked me off my bike last May doesn't (which he won't because GMP can't be bothered) I will have lost all faith in our justice system.
