How do you know the one depicted in the picture is a small one?
Is is pictured next to something else of a fixed size, like a 50p piece, to give a scale comparison of the apple pie?
Surely it's logical to assume it's a normal sized one. If you saw a picture of a well-known product they've been selling for years like a Big Mac, why would anyone not think it was going to be the size it had always been?

It shows it in the sundae pot with the ice cream, now unless they have made it so you get a litre of ice cream with it, I think its fairly easy to know that its going to be a small one. I would have never in a million years assumed it was a full sized one withe the sundae

I think you find the pie is about a 3rd less than normal size pies, otherwise the normal pies would be alot larger. McD's are always selling 2 pies for 99p, I've never seen 2 pies with ice cream for 99p. I aint too keen on the ice cream as it melts far too quickly.
