What is the point of resolution centre?

Been arguing with a seller after he sent damaged goods through this and it seems all that happens is us talking to each other. He is refusing to talk to me any more and has lied saying he put bubble wrap in package to protect items. If he had done this then we wouldn't be falling out over the damage. I have suggested a partial refund to get the item repaired and he says I must of broke it because I was very fast to complain. I give up with how thick some people are.
Where do I go next? Gonna ring TNT and have them compensate me or as I suspect tell me from the pics it's not adequately packed so then I'll have some proof that he is at fault.
Any ideas please...

    If you cannot resolve then you escalate the claim.

    You have no contract with the carrier unless you arranged it.
  • Yes, you escalate it then hopefully you return it fully tracked and get a refund, TNT will never compensate you, only the seller, although if he didn't put bubble wrap in then they may well not compensate him either as it was inadequately packaged
  • Good advice from above, you are it the best position as a buyer. Put the claim in ASAP and stop wasting your time trying to do the right thing. The seller is in the wrong ,full stop and should pay for their mistake. Good luck,you will win.
  • Hi thanks for the advice, he is adament he put the bubble wrap in. Feel like screaming with the stress he has caused me this week and to top it off he genuinely thinks its my fault its damaged! I paid for TNT as he wanted £46.50 for delivery and I paid £11,50 plus I gave him £5 to buy packaging which he never used. He even selotaped a box with normal selotape for god sake, TNT had to re-tape it with their own tape!! I would rather get a partial refund to get the deck repaired as otherwise I have paid out £30 on p&p and have nothing to show for it :( Totally fed up with it all and hoped if TNT see the pics and tell me officially that is was packaged badly and he may believe me then, he comes across as VERY thick.
    Have just finished a night shift so gonna have a look later and see if I can sort something out.

    You will get the full purchase price back if you win a dispute. So escalate it.

    As for the courier, you probably won't get anywhere with them with regards a claim, but you may try.

    PayPal and eBay are unable to force partial refunds, only your seller can allow it. If they don't then it's all or nothing.

    This was the person with the really dim seller who allowed OP to arrange their own courier- so OP paid seller for item plus £5 for packing, and then paid courier direct.

    Can someone remind me whether we had a thread recently where someone insisted that as a seller they won the SNAD as buyer basically 'collected' the item by arranging the courier? I seem to recall arguing that seller was still responsible (hence how daft they were that they had allowed buyer to arrange courier) but they claimed SNAD went in their favour once they contacted ebay- or was that on a straight collection item, I don't really recall?

    The seller is on a sticky wicket or a stickier one.
    Sticky - has to refund the purchase price and gets faulty items back (SNAD - broken arm).
    Stickier - buyer claims INR.

    The buyer is slightly better placed, depending on your morals.
    If dishonest may claim INR.
    If honest loses £16.50 for the outward postage (and won't get a bean from the courier) and has to return at his own cost for a refund on the purchase price. Or does nothing.

    It really is lose/lose.
  • So basically Im screwed then, if I do send it back then £11.50 x 2 + £5 is £27.50 so I will be down almost £30 for something that is not my fault it is pure stupidity from the seller. I want the decks but I dont think it is fair that because he didnt package it properly I have to pay out for repairs for god sake. I arranged a courier as the cheeky git wanted £46.50 for p&p and the item would of been damaged anyway, this just takes the p1ss!!!!
