Bought decks on ebay and arrived damaged?

Hi, I bought some record decks on ebay and arranged my own courier as he wanted £46 for what I paid £11 bu being fair I suggested I send hin £5 to cover the cost of packaging materials to ensure is safe arrival. Well the idiot(can think of worse to call him) has sent the decks and a mixer in a big old box with no pacakaging materials in and put a 10kg mixer on top of the turntable whch has snapped the arm off it :mad: I cant begin to explain how angry I am at this guys ignorance or plain and simple stupidity! But where do I stand now? I have emailed him asking him what he suggests, and followed up with the price of a quote for repair of £150. I only paid £305 for the lot and while it was a very good deal for what I got, and they look in good condition his stupidity has caused this problem. I explained before hand I wanted it packing appropriately so to avoid damage and he said "dont worry pal t will be packaged very securely and then he just goes and plonks the lot in a heap in a box.
I paid on paypal with my credit card hoping for protection in case they never turned up but will I be cover for this? Can I just ask for a refund and get one? I dont want to sound harsh on the seller, but I cant see him sending me £150 to have it repaired despite his fault in it all so have I lost it or can I get a refund and tell him to arrange a courier? I will almost £20 down for this even if I get my money back :(

  • Did you pay through Paypal or equal?

    If so, raise a dispute - there are rules on this and paypal will walk you through, when and how it works.

    It is important for you to have got correspondence (or tried) before you raise a dispute. Packaging can be removed, but when you reviced the package, did you take photos?

    Sorry, I see you did pay Paypal. Go onto their web site in the first instance, track your payment and see what guides/rules there are for opening a dispute.

    I have done this for items not received on one occasion on eBay, it takes a while, but it comes through.

    Also, pending on how it works, you may have some recourse through your credit card company.

  • I would open a claim for Not As Described, via Paypal. I know it got damaged in transit, but in all cases, it is the seller's responsibility to ensure items reach their buyer safely, and in this case, he's been especially reckless. If someone gave me £5 just to pack the item, I sure as hell wouldn't be putting it in a bag with no protection. I wouldn't be doing that anyway, mind....
  • Thanks, I really want this set up though they dont come by very often :( Why did he have to be so irresponsible? Just dont understand the thought process. Will see if and when he replies and if no joy by tonight I shall start with a claim. I have messaged him regarding this though so surely he could say it was ok when he sent it and the claim would be no good? Gutted is not the word!
  • He has now said he packed it excellently despite there being nothing in the box and I could of broken it so its not his problem etc. :(
  • Paypal will disagree with him, more likely than not. Ask for a partial refund, given that you want to keep the item. If he refuses, then you should go ahead with your Not As Described claim. However, they often require you to return the item in this instance, so hopefully a more experienced eBayer will be along to advise you as most not as described cases, the buyer doesn't want the item...
  • Capital one have said they will send me a dispute form and if it goes in my favour then I get a refund. Same as paypal then? Think I will raise the dispute now cant believe the cheeky !!!!!!! saying its me who broke it.

    I'd personally leave negative feedback and also give a 1 out of 5 on the DSRs for postage and packing charges as you paid him an extra £5 and he still couldn't be bothered to wrap it carefully, and also because he was originally trying to charge you 5 times the actual cost of the postage.

    Wont I have to pay to return the tiem before I get a rfeund though? Dont know how it works. He has already left me glowing feedback as I paid straight after auction(as I always do) so he cant leave mine nagative. Will get it resolved first, can see this not going in my favour as everything in life seems to be going against me at the minute. sigh...
  • Sellers can NEVER leave negative or neutral feedback any more, so there's nothing to worry about.

    If you're asked by Paypal to return the item, you do have to do so at your own cost, by a recorded method, before you get a refund. However, if you're successful via your card company, you probably won't have to return it.

    Make it clear if you're dealing with Paypal you don't want to return the item, and that you want a partial refund to reflect the cost of the repairs you'll need to do (and send them links to proof of this cost so they can see you're not trying to pull a fast one).

    however, they do tend to be very black and white so I don't know how far you'll get with that to be honest. You can close the case regardless but you may not get any money back, ie if they say you can only have a refund upon return, you can close the case without sending it back, but then won't get a refund.
