And how do I know this guy wont just say that I havent sent it? Just had a local repairer on the phone and he wants £190 for a whole new arm
He cant believe what an idiot the guy is sending the stuff the way he has. I have set up a claim with ebay, he had replied to my message earlier still saying he packed it perfectly but has ignored the dispute. If he ignores it will I get auto refund? Should I carry on with capital one claim or not now I am going through ebay? Sorry for so many questions just totally fed up and want this over with.

If you are asked by Paypal to return the item, then if you choose to do it, you MUST use a method of delivery which can be tracked online, ie a decent courier or Parcelforce. This will be at your own expense, unfortunately, and you're probably not going to get this money reimbursed.
I believe that if the seller keeps ignoring the dispute, it will be resolved in your favour without any further input required from you.
Personally, I'd keep both that claim and the card company claim open, but if one refunds you, stop the claim with the other or else you could be liable for fraud and could get into a lot of trouble.0 -
Many thanks. I know he won't want them back now as re-sale value is lots less. I'm still trying to find a cheaper repair to make a deal with him. Not that I should but if I have to return item again then I'll be down 35-40 quid and I'll gain nothing from this! Guess if he keeps ignoring me I'll get a refund automatically? Still not ideal just want him to see I'm not taking it lying down, have told him to come to an arrangement and he ignores it. Aaahhhh0

Well, sit back, let the case close in your favour, use some of the refund (assuming you get it) towards repairs, and leave him negative feedback and poor DSRs for item as described, communication and for postage and packing charges as I explained before. It's up to you whether or not you're more generous with the rating you give for dispatch time.0 -
Just open a paypal item not as described dispute, then when you win (which you most likely will) you can just send them back with the cheapest courier you can find, probably https://www.hermes-europe.co.uk, or any of the following:https://www.parcelmonkey.co.uk
