Mis-sold Vodafone Contract?

    Makes no difference, Vodafone took no action against my 3rd party AUTHORISED retailer for miselling a plan - & I proved such to Vodafone CEO, the 3rd party STILL got their commission in month 6 and I got landed with the buy-out charges & I defaulted as I was not paying out for a contract that was not as described - Voda got all my screenshots for the order & offer but it was not proof enough !
    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

    The problem is that you can easily use the recording only to have the contract cancelled, not to enforce it. BTW, if you don't make the second party aware of recording, the record is inadmissible for a court.
    Incorrect, a recording for personal use. A transcript of such in court is evidence & if the other party denies transcript in any shape or form it is such the party owning the personal recording can ask for it to be submitted as evidence.

    Well, you are 'trained' and probably know better, but as usually you fail to back your opinion with any facts.
    It has been posted many times here (with the facts) that without warning you can legally record telephone conversations for personal use if you are not intending to make the contents of the communication available to a third party. I am no expert, but I think your post at least requires explanation how court is not not a third party.

    Court ?no your wrong there, court is a place where legal proceedings take place.... a JUDGE is not a third party - they represent legislaton....if people want to google they should, self education is an empowerment - as usual you grumble about another of my posts !

    Do you mean that I should have googled? I have. Usually after googling people post some links. The links on 'third party' have been posted many times here. However, I am not convinced that court/judge is not a third party and I don't see any links...:(
    Looks more like an opinion (as usually). Not that I'm saying that this opinion is wrong.
  • Just to add to the thread - have been a loyal Vodafone customer for many years but just reached the final straw now.
    Havent taken a phone off them in 2 years or more and early this year requested changing to a monthly SIM only rolling contract to try and save some cash to afford the new iPhone 4/4S. Salesperson was specifically asked if i could upgrade phone at any time - YES!

    Tried to renew a monthly deal with added text and data, and told its too early in my 12MONTH SIM contract!!!! Mis-SOLD!!!!
    £55 fee for this early upgrade; or £50-odd to pay up my term, cancel and get my PAC code!!! Customer rep was of no help, unsympathetic and
    in parts just down right rude and speaking over me.

    I asked to speak with a manager. I was told it wouldnt help to do so and that i had been given all relevant information.
    I asked to speak to Customer Complaints department and was told there wasnt one. Sooooo frustrating....i'm so annoyed!

    Cant believe they are turning away a good customer ready to pay for an iPhone and £30+ a month.
    Glad i'm now on the £10 minimum until i can change operator. Still shocked that my custom is held in such low regard!

  • There all as bad as each other to be honest. They all tell a pack of lies.

    I still believe recording calls yourself stating clearly at beginning that "This call is recorded also for informational purposes"

    I once may years ago was mis-sold a three contract. I recorded the conversation and emailed directly to their head office threatening to upload this to various sites as youtube and pass to watchdog etc. I received a call directly from their head office in which they honored the contract term.

  • The problem lies in a bigger mess now that the contract has been sorted out ok.

    I ported my number from O2 to Vodafone and on Monday it suppose to fully port. But now its been over two days and I cannot receive incoming calls or text messages. If I try and call my number I get a your number has not been recognised please check and try again message.

    I have called Vodafone porting team as I have nothing to do with O2 as half my number has ported and they keep saying that O2 have messed something up and we (voda) have to email O2 to get some further details for it to port across. This was suppose to happen today but O2 never replied back to them. Voda keep telling me you have to wait until they reply back and that voda cannot do anything. They credited some money onto my account but this is beyond the point. I now have a phone which can't even receive calls. I said that what if you just issue me with a new number. The crap lady then said that we cant do that until this number fully ports. Just say it never ports. I could be like this all the time.

    I do not know what my options are. Would a report to ofcom help? I am basically paying for service that doesnt even work. If I cancel my direct debit these muppets then will take me to court :(

    To be fair to Voda, it *does* indeed look like O2 failed to properly release your number. Might take a few more days to get sorted. While this is going on, do you have access to another mobile you could pop your O2 sim in to be able to receive calls? Bit of a PITA because you'll have to carry 2 mobiles for a bit (the one with your O2 sim for incoming and the one with the Voda sim for outgoing)

    Edit: sorry read too quickly and now realised that you don't seem to be able to connect to your number at all. What number is showing when you send a text or make a call with your Voda sim?
