OK, thank you. Would they be able to claim provable losses for the rest of the order? And how would it work technically? I suppose I am concerned that if I tell them we aren't going to provide the measurements, that they will say, OK, well we'll keep all of the money then or something? Thank you for responding sensibly, some of the people on here have been quite upsetting/unsympathetic.0

I'm sorry, but I know little about the DSRs. However, as I understand it, if DSRs do not apply in these circumstances, then you would be in breach of contract. As such, the seller would be entitled to claim damages from you - usually losses that they incur. They would have to mitigate their loss and prove their loss, meaning that they wouldn't be able to charge you the full cost of the fabric if that fabric could be used for another order. I would be tempted to ask them to supply evidence that the fabric has been delivered from the suppliers0

OK my take on this is that the kilt makers as soon as your OH placed the order over the phone called the mill (which more than likely has nothing to do with them...) and ordered the material. The Mill therefor cut the material immediately and the company you are dealing with would be liable to pay the Mill for the material whether you want it or not.
Most tartans are "owned" by a certain mill - that means no other mill can produce that particular tartan and there can be a very limited call for a certain tartan - I know that my husband was the first to have a kilt made in the tartan we chose as we had to get licence permission etc from the tartan owners (his old school).
I'm not sure why you think the tartan isn't a "proper" tartan... What would qualify it as not being "proper"? IF the register agrees that it's not fit to be called kilt tartan then you'd possibly have an argument, but personally I'd say that you (well he...) is going to have to pay either to have the kilt made or for the material (which is pretty expensive if it's strictly licensed...)DFW Nerd #025DFW no more! I have asked my OH what he would like, whether he would like to go ahead with order. He has said he is fully in support of looking at all the options, because he does feel somewhat duped by the company. I will get him to post on here when he wakes up!0

At the moment as far as they are concerned, you have cancelled half the order already, your trying to cancel the second part which they have already invested time & money in which will ultimately leave them with nothing. No wonder the trader is being difficult!
Whether you post, your husband posts or how many threads you make or how many times you ask the same question over and over again...... the answer isn't going to change. And you have already been given the answer and the advice you need to go forward.
Sorry to be blunt, but stop faffing around and discuss a settlement figure with them, but as long as this thread continues to go round in circles with you trying to find a way to see them out of pocket (whether money or time) because of your mistake, you won't get any sympathy. Because lets face it, it is YOUR mistake, not theirs.
With regards to the items you have successfully cancelled under DSRs. The retailer MUST refund monies no longer than 30 days after cancellation. Only then would I have thought the credit card company would have been interested in your case. I also hope you are at the moment only disputing part of the payment with the CC company.0
