Me too. I bought early on the first day and was in a rush, wish I'd waited and stood my ground with them. Think I'm owed about £10. Tempted to go down with my receipt later and see what they say.0 -
Hi guys
Does anyone have any idea if this is likely to be repeated before xmas again? Thanks in advance
Please remember to thank fellow MSE'rs :beer:0 -
Got a response from the ASA todayThank you for your recent complaint about Argos Ltd, submitted via the ASA website.
We’ve carefully considered the points that you have raised, however I must inform you that we do not think there are grounds for us to pursue an investigation under the CAP Code on this occasion. I’ll try to explain why we’ve come to this conclusion in a little more detail.
I should start by saying that the ASA can only consider intervention when there is convincing evidence to suggest that our Codes are likely to have been breached; for example, when an ad is likely to cause widespread or serious offence, poses a significant risk of causing harm, or is likely to materially mislead consumers about the product or service that is being advertised.
In this case, Argos contacted us and informed us of an error with their national advertising campaign. They explained that the “3 for 2 on all toys” offer was genuine, but that customer feedback had alerted them to the fact that the initial ads for the promotion did not make clear that it was not available in conjunction with any existing offers (such as the 2 selected toys for £15 offer which was running at the same time). They told us that the offers were intended to be mutually exclusive, and that their till systems were configured to offer a customer the best deal possible.
Argos assured us that, as soon as they became aware of the issue with their advertising, they took steps to amend or withdraw ads wherever it was possible to do so. They told us that all press and TV ads that were due to be published or broadcast on the weekend of the 22nd October were successfully amended to make the limitations of the offer clear. Finally, they explained that they had set up a store and contact centre communication to explain the situation to customers and apologise for any inconvenience caused.
Whilst I do understand your frustrations in this case, we’re satisfied that the advertiser undertook all the appropriate steps to correct their error and ensure that the number of customers that were affected remained to a minimum. Given that the ads that omitted information about the availability of the offer were immediately amended or withdrawn, we do not think that there are suitable grounds for us to pursue a more formal course of action in this instance. I realise that this decision may disappoint you.
Although we won’t be taking any further action in this instance, I’d like to thank you for going to the trouble of raising your concerns with us nonetheless.
Our website, https://www.asa.org.uk, contains more information about the work that we do, including the results of our recent investigations.0
