I bought an MP3 Player from Argos and it will not charge. Rang Archos and they asked a few questions and sais it was faulty.I purchased this on 27th of September.
Argos refused to replace and pointed out that it had on the receipt Exempt from 30 day Guarantee as are Mobile Phones and other Electrical Items.
What am I supposed to do; throw it away?

Aren't you confusing a return with a repair? They're not obliged to offer you an automatic replacement, but they are obliged to offer a repair/replacement/refund under the normal 12m warranty-their choice.
It appears that the numpty you spoke to just thinks you want to return it because you don't now want it, not because it's faulty.
I presume that an MP3 player cannot be returned for hygiene reasons (because it has earphones). No free lunch, and no free laptop0 -

As it is such a short time since I bought the item, does not the Sale of Goods Act say it should be relaced?0

No it does not-it's at the shop's discretion. But with a small electrical item like this that is almost certainly what they'll do anyway. No free lunch, and no free laptop0

Argos will almost offer to replace it or refund you whichever you want0

The 30 day guarantee was just for returning something if you don't like it, if it's broken they should replace it as it's less that 6 months old0

They will not replace it as it is an exempt item!!!!!!!!!!!0

They should replace it, or offer a repair.

You need to go back and speak to someone who knows what they are doing.0 -

Either you or they shop assistant misunderstands...To protect your personal security, we are also unable to accept returns on some non-faulty imaging and recording products such as MP3 players and digital cameras.

As already advised, they do not have to replace it. You will be offered a repair, replacement or a refund-the choice is theirs.
