Were there any warning signs of this guys character in their feedback?
I am sure any Bike repair shop could make a written report on the condition/fault of the fame as evidence if needed for Ebay/small claims.
I wouldn't mention small claims until you are ready to actually go through with it.0 -
Has the item been marked paid, if not then you can do it. Again go to the item & in the dropdown box you should have a payment sent tab.
If it's not been marked as paid that would stop you from opening an ebay dispute.0 -
Hi. I bought a bike on ebay and it was delivered next day by courier.
I unpacked the bike and whilst assembling it I noticed a crack in the frame, which renders it dangerous and unsafe to use. I informed the seller within an hour of receiving the bike and they denied any knowledge of the damage. Upon closer inspection of the ebay listing photos, the crack can clearly be seen on the bike, however, just looking at the photos and not the bike itself this mark can be mistaken for a surface mark, but the damage is obvious when looking at the bike in person.
Unfortunately I think I'm at the mercy of the individual who sold me the bike now. I initially paid by PayPal, but the seller refunded this and said he doesn't accept PayPal and that a bank transfer or deposit was the only method he would accept. I discussed with the seller and agreed to go with this.
Can anyone give me any advice on what action I should take to resolve this situation?

For starters you can report them for not accepting ebay. You could TRY opening a dispute in Ebay, and see what happens, but ultimately, you might have to take the seller to the small claims court to get your money back.Should've = Should HAVE (not 'of')

a breach of ebays policies as Paypal is the ONLY officially accepted payment method allowed on eBay and to sell on eBay you must accept Paypal as a payment method.
