I'm not going to get into morals here - just what I think as an outsider. This isn't just a"gift" ring, it is a ring given in contemplation of marriage therefore if the marriage doesn't go ahead the buyer should keep the ring. Obviously neither party wants this to end in marriage for various reasons so she should treat this as a lucky escape, and he should get the ring back. Citizens advice will arrange a free session with a solicitor, or you can raise a claim in small claims court. What do you have to lose?!0

OP - I think you've made the right decision not to pursue it. I don't know the circumstances of the break-up but, if it wasn't her fault (and it sounds as if she didn't instigate it), then you should let her keep it/sell it/whatever.Oldernotwiser wrote: »Who broke off the engagement?

This is more or less my opinion also.
If the girl breaks it off because she changes her mind, she should return the ring as she is breaking the commitment to marry.
If the man breaks it off because he changes his mind, he should allow the girl to keep the ring as he is breaking the commitment to marry.
If either party breaks it off because the other cheated, it's less clear. I think that the wronged party should get to keep the ring tbh. I assume that this isn't the case here, though.
If the ring is a family heirloom, it should be returned to the family from whence it came. In ALL cases.
All imho of course.Section 3(1) of the The Law Reform (Miscellaneous Provisions) Act 1970, would allow the groom to recover the ring if it was given “on the condition (express or implied) that it shall be returned if the agreement is terminated”.
Section 3(2) states that the gift of an engagement ring is presumed to be an ABSOLUTE GIFT, but that presumption may be rebutted by proving that the ring was given on the condition, express or implied, that it should be returned if a marriage did not take place.
