How do i get engagement ring back?

Hi all, this is my first post but I have been on mse for ages but just lurk rather than post.
Just recently broke up with fiance due to some reasons I'd rather not go into lets just say it wasn't her fault. Long story short she is refusing to return the engagement ring. I feel that this is now my property and should be able to sell it to try to recoup some of the money I spent on it (about 3k).
Any advice on best course of action?

I presume that when you 'gave ' her the ring you did just that. I am guessing it was not a 'conditional' gift i.e. I will give you this ring but you only get to keep it if you marry me. The reason I mention this is because I recall one of my Law Lecturers discussing just this 30 years ago. I have to say his view was that unless you specified the ring to be a conditional gift then she was quite entitled to keep it.
Maybe times or attitudes to this have changed ?0 -
Doesn't the fact that its an engagement ring presume that it is conditional? Could be more blurred than I first thought. Thanks for the input0

Agree with greenval. It was a gift.
It's not even as if the break-up was her fault.
Unfortunately for you now, I'd say if you were happy to spend that money on her at the time then there's not a lot you can do now.0 -

Technically an engagement is a promise to marry....if that promise is broken then all presents should be returned to those who gave them and the ring technically should be returned to the giver...however in realality this doesnt always happen....its only once the marriage takes place that the gifts and posessions are divided equally should the marriage break down...
Having said all that...I think it could prove a contentious issue to go and demand the ring back...is it more a case of money spent...money lost....maybe its time to move on rather than cause further distress on both sidesfrugal October...£41.82 of £40 food shopping spend for the 2 of us!

I would imagine a 5 minute chat with a competent solicitor should give you your answer. I’m sure there’s plenty of case law around this.0

If not, my apologies and suck it up, you gave the ring as a gift, it no longer belongs to you, morally you have no right to it especially since you seem to be the one to cancel the engagement:o
Lessons need to be learned.
1. think before you commit for the rest of your life
2. is spending over 3k on a piece of metal with compressed carbon very MSE
