It seems that this thread is pretty much 50/50 divided between whether I have a case or not. As far as I can see, the sensible course of action would be for the seller to progress a case with RM (either for the minimum, or for more if they can push for it), while I pursue a case against the seller. It all sounds pretty messy and is a shame as the seller has been 100% cooperative throughout this (although the cynic in me would suggest that they are cooperative so that I'm less likely to pursue them later!).
To whoever suggested that I have enough cash to write-off £350: no, I don't. It's the last thing that I want, but I am wondering what the realistic chances are of me seeing the cash in the future.0 -

Actually, looks to me like you have 5-6 people telling you you have, and one telling you you haven't.
Ultimately though nobody can tell you what a judge will decide, it depends on what prove the seller has and how credible it is. And to me, personally I don't see how an admission from RM that the parcel could have been given to anybody + an unidentifiable signature carries any credibility in the slightest, made even less credible if you take evidence of your signature.
Who cares how nice the seller is? You didn't buy from them to make a friend, you bought an iphone from them which they failed to deliver, now your out of pocket by quite alot of money. No doubt the seller will claim what they can from RM, but thats their business -- yours is trying to get the product your ordered which they failed to supply or your money back.
If you did fail a county court claim, it would cot you £35 to file and i'm betting they would settle before the case going in front of a judge -- which will cost about £55 -- costs you will no doubt add to the claim.0 -
Ebay have already ruled against the OP so phoning them is not going to help. eBay already know the details of the case and made an independent ruling based on the evidence presented by both parties.
Well based on the MANY threads on this forum where people have phoned Ebay after a ruling to get the case re-opened, and have been successful, then there's nothing to lose by trying!

But ops already said the parcel would have been left with anybody (as told by RM). So their proof of delivery is as irrelevant as that in my example, as RM haven't delivered to the address on the consignment note. The inelibile signature is pretty worthless if being disputed, anybody at any address could have provided the signature -- it proves nothing on ops part.
If this thread is anything to go by, maybe you shop stop offering advice -- or at the very least place a disclaimer in your signature. Here's the best one:

How do I substantiate this FACT? Maybe next time the post lady delivers a parcel to me I will record a video of her pulling out her book and pen, sign and date this row here please (on the same row there is also a sticker placed with a barcode on...
How can you possible be sure, let alone blatantly tell me what i'm saying is wrong? This is my experience, this has happened when i've had RM parcels delivered to me. How common this actually is I don't know, but it happens.

Actually the little book isn't rubbish!
My postie uses it regularly when delivering parcels. The barcode sticker from the parcel is stuck in the book, I sign, date and write my surname. Simples! And a lot better that those bloomin computer thingies that can't actually caputure my signature properly.LBM:FEB 2008

some may consider it odd that you claim others posts to be "unsubstantiated" whilst offering no substance to your opinions & overlooking points others have made.
if somebody disagrees with me that's fine, atleast when others disagree with a post they are able to backup their points with a valid argument.
