eBay item delivered to wrong address by Royal Mail

    You're obviously not short of money if you're prepared to write off £350!!

    Your contract is with the seller, and not RM, so if I were you, I'd be writing to the seller demanding that they refund you.

    Ebay have already ruled against the OP so phoning them is not going to help. eBay already know the details of the case and made an independent ruling based on the evidence presented by both parties.

    The only other option is for the OP to launch a legal action against the seller to get their money back. However I question whether this is going to be successful as the seller has proof of postage and proof of delivery. It sounds like the whole thing is going to be a coin toss as to who wins. The Seller will produce the written evidence and the OP will prove evidence that the signature is not his. Its all going to get messy and in the long term may not be worth it.

    Its a bad situation though and just goes to show that there are bad seeds in the world who steal anything. I can forsee another thread on this forum "sent Iphone by mistake, do I have to contact the seller?"

    100% in agreement with this and I am surprised that ebay have sided with the seller - hanging around the eBay thread you often see the opposite (which should be the case imho).

    If ebay continue to resist any attempts by the OP then it will resort to being very, very messy. But probably worth it for £350!

    What if I sell an item to some guy in Coventry, then send the item to my friend in Lees... I now have proof of postage and proof of delivery + an unreadable signature. Do you think I would win in court?

    Well no because the proof of postage and proof of delivery would be to a different address to the sellers. You're ridiculous example macro has let you down again......

    Hypothetically the OP could have signed for and received the parcel. Then they could be saying they didn't to get their money back. If eBay found in the buyers favour it would open a big can of worms that scammers will be keen to exploit.

    The item should have been sent special delivery as recorded items sometimes don't even get signed for. This would leave the seller with no proof of delivery and open to a claim.

    But ops already said the parcel would have been left with anybody (as told by RM). So their proof of delivery is as irrelevant as that in my example, as RM haven't delivered to the address on the consignment note. The inelibile signature is pretty worthless if being disputed, anybody at any address could have provided the signature -- it proves nothing on ops part.



    If this thread is anything to go by, maybe you should stop offering advice -- or at the very least place a disclaimer in your signature. Here's the best one:

The seller has fulfilled everything he said he would. wrong, he hasn't fulfilled the contract by delivering said goods to the nominated address eBay agree which us why they have not found in the ops favour.irrelevant, ebay are not impartial and are not judges. You're other point about the book idea is frankly idiotic, major companies can't run a business like that odd, since i've signed for several parcels with pen and paper over the last few months, so clearly some posties DO operate like this
