    For example,
    £1,429 in charges
    £27.40 in overdraft interest
    Total £1,456.40
    1466.58 x 0.00022 = 0.32 - This would therefor be £0.32p on a daily basis.
    Please ensure you do your own calculation based on your totals


    hi rex,

    im just at the stage of filling in the moneyclaim 'form', ive used the template in post 6 but the interest claimed on a daily basis is confusing me....

    the first part of the post i have quoted shows £950 x 0.00022 = 22p. not on my calc is doesnt, it shows 0.209 (21p)

    then, with the example u give later, you use £1456.40 total charges, then £1466.58 x 0.00022. whyy the differene between 1456.40 and 1466.58, am i missing a calculation somewhere?

    basically, my charges add to £1173 and interest amounts to £378.39 making a total claim of £1551.39. so is the daily rate figure 1551.39 x 0.00022 = 34p?

    That's true (0.209). I must have hit a wrong button on the calculator when I did this.

    This second one wasn't my calculation. I was quoting someone elses post. This looks like a typo.

    Your daily interest is worked out at charges (only) X .00022. You are including the interest here (you don't do this). The daily rate for you is £0.26 (0.258 rounded up).

    I have also received notification from the court (filed online claim after following all other advice/procedures from this site) saying the Nationwide are defending my claim. What happens next? I would like to be prepared.

    I don't understand why this wont work for you. It has worked fine for other members. Are you copying it as it is (not adding breaks etc)

  • :confused: can anyone help me with this? both the templates i've been directed to are too long for the 1080/24 line limit on the MCOL site and it wont let me complete and submit my form. i'm not sure which bits of the template are essential to keep or i'd just write my own.
    can anyone help?

    Don't select any of them. You only need them if the bank doesn't respond. Keep your eye on the claim, you can see how your case is proceeding.

    Can you help me, before i press send on the MCOL. Quick question, this is what i have put for partiuclars of claim

    "The Claimant has an account XXXXXXXX & XXXXXXXX with the Defendant,
    opened 2000. Since 2000 the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £2110.00; Interest per S.69 County Courts Act 1984 of 8% - £331.23 continuing
    at 8% until judgment or settlement at a daily rate of £0.46; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court."

    However, when you tick the interest box, it states to add this

    "The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}".

    Is this in the above particulars of claim correct????
