    Your daily rate of interest needs to include ALL charges INCLUDING your claimed interest, multiply 1042.10 by 0.00022 to give the daily rate of £0.23.

    That's not right. The £137.10 interest claimed is the statutory interest claimed with the court claim. You DO NOT include this interest when you work out the daily rate of interest. In this case the figures are....£950x.00022=22 pence a day.

    This section of the advice from CAG is on about contracual interest claimed from the account, this doesn't apply here...........

    This daily rate of interest is calculated by multiplying the total value of the claim (charges plus overdraft interest, if claimed) by 0.00022
    For example,
    £1,429 in charges
    £27.40 in overdraft interest
    Total £1,456.40
    1466.58 x 0.00022 = 0.32 - This would therefor be £0.32p on a daily basis.
    Please ensure you do your own calculation based on your totals

    Ah right, thanks for clarifying that :T , we're just about to put our claim through and followed the template on there. Shame they haven't got proper templates for credit cards :(

    Hi there

    I hope someone here can help me.

    i am currently in the process of taking Barclays to court for the sum of £1139 including interest on my account.

    Barclays have filed for a defence agaisnt me.

    Now I am currently looking at their defence document, and one of the reasons they are defending is due to me filing for 3 charges that are outside of the 6 year window.

    how will this affect my case??

    I am getting worried now and I am starting to regret not accepting their £400 offer previously.

    They also state that I did not submit a list of charges in with the claim.

    is this a problem? or have I not reached this stage yet?

    I am currently filling out the N149 AQ from and I am starting to get a little scared!

    will i have to defend myself in court??

    There are a lot of clauses on their defence i really dont understand, and i think i might be out of my depth.

    Hi, i am page 5 of the moneyclaim site (the one where i input details of the claim).

    I have filled it all in, using only 991 characters etc

    but when i click on submit, nothing happens .....

    I cant work out what i am doing wrong\ not doing

    has anybody got any ideas?

    check how many lines you have written.

    its not just characters, its the amout of lines too

    I'm sorry this is probably very dim but how do I go about doing it online? So far i have only sent a letter asking for my statements. Then would i be able to do the rest online?

    you need to send 2 more letters after receiving your statements (giving a totral of 3 weeks for them to settle with you) before you can commence court action online. You can't just skip to it

  • hi there. i copied and pasted the template on this site for the 'particulars of claim' section on MCOL form but it's too long. they only allow 24 lines and 1080 characters! i've trimmed as much as I think i can but it's still too long and so the site wont allow me submit my form. can anyone tell me which bits i can leave out without affecting the gist/impact/legality of it?

    Did you use the template in post #6 of this thread? Others have used this with no problems.
