    Dear All,

    Sorry if this is a really silly question but I have to ask. Yesterday submitted my my particulars of claim via the Money Claim website, I have checked today and it is showing that the status of my claim is issued and that HSBC now have 14 days from the date of issue to respond.....now this is my query....do I count today or start counting from tomorrow (sorry I know that sounds really thick).......also do I count just working days or can I include weekends. I am of course assuming I would only count working days but wanted to check.

    The problem I have is that if I start counting from tomorrow and then only count weekdays my 14 day deadline is when I will be on holiday.....which means I might not have access to the internet :-( Hopefully I will be able to access it somehow to finish off my claim..!

    I have sent all my letters to the bank, but not included the 8% interest, although i did make enclose a copy of all the charges. I am ready to file my MCOL, and can I had interest at this stage, even though i have not mentioned it in my previous letters to them?

    Also I have looked at the Particulars of Claim, and it does not allow for the account number and sort code to be inserted, should I include this?

    Is it wise to just copy and paste? I have used the standard templates off this site thus far.
    Can anyone help on any of these point please.

    Look in post #6 in this thread. The particulars of claim has a space you can put your account number (the sort code isn't so important). Yes, you can add the 8% interest at this stage.

    The particulars of claim in post #6 is fine to copy straight into moneyclaim. Just edit the parts you need to. I recommend not changing the wording of it, as you may delete an important part.

    The Claimant has an account XXXXXXXX (put your account number)with the Defendant, opened DATE. Since DATE the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

    Im claiming 905.00 and interest 137.10 so = 1042.10 do i add the 8% on aswell?? Also, not even sure when my account was opened with them,do i need this??? please help!!!

    Rex, it has now come up after clicking yes to "Do you want to reserve the right to claim interest?: that i have to put this paragraph in

    The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from I PUT DATE ACCOUNT OPENED??(date when the money became owed to you} to I PUT TODAYS DATE{the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of I PUT 0.20 ??{enter the daily rate of interest}.

    SORRY, just really dont want to mess this up!!!
