    Thank you once again.

    Im not claiming in Scotland,its England.

    Where you say to work out the interest using the calculator,which has to be from first charge til claim date (which will hopefully be today) does this mean that I have to add the extra charges since my last charge that they stated on the statements they sent me as my total claim? Which would then mean that Im claiming more than six years :confused:.

    So would it be: If Im claiming £1,236 which is charges from first charge to last charge on statements they sent of six years & the interest from the calculator which works out as £347.46,this is what I would put:

    The Claimant claims Interest under Section 69 of the County Court Act 1984 at the rate of 8% a year from (22/10/01) to (10/04/07) of (£347.46) and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of (0.27).

    OR

    If Im claiming £1,272 (which is charges from first charge to date of court claim,because Ive added more charges since last charge) & the interest from the calculator works out as £347.77,the £347.77 is what I would put as interest,is it?

    Im sorry if Im boring you but I do really need someone to stay with me on this as I want to put the claim in today as my head in going round in circles.

    You can add any charges up to the day of claim if they are within 6 years. So if you claim today your charges can date between 22 June 2001 to 21 June 2007 (if you have charges during that period of course. If your account started at 22/10/01, that's your start date). You only seem to have charges since 22/10/01, so you are well within 6 years, unless I am misunderstanding something.

    Nice to hear Im not boring you,Im just boring myself :rotfl: .

    Yes Im well within the 6 Years.

    But in my letters to the bank Ive only stated the amount I want to claim from the first charge tothe last charge thats stated on my statements they sent.

    Does this matter? Its ok to change this is it,to add the additional charges that have been applied to my account to my previous total & put this in the amount claiming box on the MCOL form & the interest which again would be more than previous in the interest box?

    What I was getting confused with was how I was to work out the interest from my last charge as on statements up til court claim date but as I know from my recent statement I am able to work it out now from this.

    Does this make sense?

    As I said, you can add any charges additionally occured up until the day of filing the claim. Doesn't matter you didn't tell the bank, they had more than enough time to react to your previous claim, they haven't, and now it's more than before. Tough.

    Just input every charge in the calculator with the date it occured and add all this together to your total interest. You might not get a lot of interest for a charge which only occured, say, last week, but input it anyway to have it all complete. If you have online banking, you will see all transactions up to date so will be able to get to all bank charge dates you need.

    One last question (I think).

    Is the section of Particulars of Claim I showed you ok to type in the MCOL or does it need to include anything else?

    Dont want to miss anything out that definately needs to be there.

    Doesn`t it have to include:

    Account Number & Date Account Opened ?

    There are two versions on this forum: Martin's and Rex_Mundi's (the latter is in post 6 and 11 of this thread here). Whichever one you choose, you should put the account number in it. Rex_Mundi's, which is an abbreviated version, because some people say Martin's version is too long and won't fit, mentions the account number ("The Claimant had an account xxxxx with the Defendant.") It does not matter which version you choose if you can fit it in, but yes, do mention the account number.

    natwest have agreed to settle my claim but out of court, i have already started proceedings against then via money claim online can anyone tell me the best way to cancel/stop the claim

    Wait until the money is safely in your account, then write an informal letter to the court saying that you wish to discontinue your claim as the bank has settled it.
