How many more times does this have to be said - it's not a FINE!!What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
-
Manager from my Asda store (Bedminster) rang me yesterday to confirm the fine had been quashed and he had 'had a word' with them to be a bit more lenient.
Fair play to him for coming back to me which is rare these days.
Excuse my scepticism AJ, but I wonder if the manager would be prepared to put that in writing for you.
You have merely been appeased on this occasion and nothing whatsoever is going to change here anytime soon for you or any other customer that overstays in future.
Also, be prepared for the possibility of TCP suffering a memory lapse in conveniently forgetting the managers intervention. They may begin sending you a crop of threatograms which should of course be totally ignored.
Nonetheless, a good result and I hope it stays that way for you.
Oh, and as already stated above, it's not a fine.0 -
i got a fine a few days ago while parked in asda. are they legally able to find out your details from dvla? does anyone know of anyone who has actually been taken to court over this?0

No you didn't get a fine. You got a fake PCN like most people on this forum. I had one myself 4 years ago in a Supermarket car park and laughed at it.are they legally able to find out your details from dvla?
Yes. So what? They then send the letters shown in our second-to-top thread 'PPC letters & threats' and you just ignore them. Then they stop.does anyone know of anyone who has actually been taken to court over this?
No, not from a major Supermarket car park. PPCs rarely even think about Court anyway and if this is Town & City then we can certainly tell you they only do letters, not Court.
This is NOT a fine!
Please wise up, stop taking a scam seriously and read the thread I mentioned, second top of the forum index which is only one click away (see my signature).
Also watch the Watchdog clip on that thread - and watch Watchdog tomorrow night as they are covering the scam operated by a PPC this week again.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

1: it is not a fine its an unenforcable invoice
2: legaly sort of, as the parking compnany probably uses the BP@A shenanigans as an excuse to have a valid reason to access your private data
3: I you ask a member on here, Give them FA, they have taken the parking company to court for harrasment ( therres another more recent case on here somewhere
4: just out of interest for what reason are they trying to scam you? ( disabled parking/yellow lines/over time? )
if its disabled, and you are actualy disabled then they are ( potentialy) in breach of the equalities act and could be in some serious trouble., if your not and you did, you shouldnt park in a disabled space, but they dont have any power to fine you for doing so.From the Plain Language Commission:

And if ASDA weren't aware of the Equality Act 2010, they are now. I told them. And we've had a report of old signs being taken down. The acquisition of wealth is no longer the driving force in my life.0

With reference to the entire issue of supermarket parking:
REMEMBER:
1. Its private land. the Road Traffic Act does not apply
2. Only the Courts can issue fines. Anyone else who claims they can is lying or mistaken.
3. The only tenuous claim the PPC's have is to try and claim you entered into a contract with them, and that you committed breach of contract
4. Even if you DID enter into a contract (dubious and highly unprovable), they cant inflict a penalty charge on you for breach of that contract, they can only claim damages for actual losses. What are the actual losses in a free car park? NOTHING!!!
5. because of this, it is illegal to try and include a penalty clause in a civil contract, making the contract, if it ever existed, null, void and illegal.
6. Therefore, its fairly easy to show that there' parking charge' is unfair, disproportionate, and constitutes an illegal penalty charge.
7. The lines they paint in the car park, the signs they put up that look like road signs, the bay markings, are all fantasy. they mean nothing, they have no legal force.
8. PPC's also have no powers or legal authority to plaster there toilet paper on your car for bald tyres, out of date road tax, defective lights or any other defect or illegality of your car. Its none of there business.
THE ONLY EXCEPTIONS:
1. Make sure the land isnt Railway land. Then they MAY try and charge you under Railway Byelaw 14, except a PPC cant, the railway company has to. Railway Byelaws and private parking is a confused mish mash and need sorting out. The first step is to establish;ish who exactly owns the land, and who issued the ticket, and if its issued under Byelaw 14 (some PPC will claim it is, but they aren't authorised to issue under byelaws).
2. If you are in a Hire Car, the Hire company may pay the 'fine' then try and charge you. You have to make sure they dont do this, and you have to make them realise even if there is a clause in the contract that you agree the pay legally issued road or parking fines from the police or council, thats DOESNT include the fake parking fines from a PPC.
3. If in doubt, the best strategy is ignore a private ticket, bar the above.**** I hereby relieve MSE of all legal responsibility for my post and assume personal responsible for all posts. If any Parking Pirates have a problem with my post then contact me for my solicitors address.*****0 -
Hi, my pregnant wife has just got one of these from stockport Asda for going over time. I was just going to pay it but after reading the above I gather I just dont pay it. Will this appear on any credit checks as don't want to stress her out if letters don't stop.
Thanks for help0 -

Of course it won't, any more than demands from phishing emailers would affect your credit rating if you deleted them!
Why don't you come off this random thread and read the current forum? We have new threads posted every single day about this scam and a sticky info thread with a Watchdog clip you MUST BOTH WATCH!
See my signature for how to get back to the main forum index - it's just one click away (I see you are a regular MSEer so you will know this already, sorry). Anyway, the sticky info thread you want to read is 'PPC letters & threats' (second to the top of the parking forum list).
HTH, thank Gawd you didn't pay. Can't understand why you nearly did TBH...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Take a good long read on here about these parking tickets, and you will soon see them for what they realy are - a Scam.
And no they wont appear on your credit check, despite the crap that you will get form some so called debt recovery ( we have no powers and theres no debt to recover) firm.
Next, to work out how much you owe the car park company apply this formula: amount of time that you overstayed in minutes = Cost to park in that car park for that amount of time.
if its a free car park the cost for ( say ) 30 minutes is £0.00, so you owe £0.00. If its a pay and display car park and it costs £0.80 to park for up to an hour ( paid in 1 hour blocks) and you overstayed by 30 minutes you owe them £0.80don't want to stress her out if letters don't stop.
If it was me, i would also raise a compplaint in person at the ASDA in question, warning them that someoen is opperating a scam in the car park, by issuing unenforcable invoices dressed up to look like fines from an offical statory authority, and using threats to try and make you pay up ( demanding money by menaces) asthen remind them that the sum demanded is unenforcable as it is an unjust penalty charge, and that only the police/local authority can issue penalty charges. From the Plain Language Commission:
