    You can only claim for one set of missed hours, as you'd chosen to take time off for one delivery anyway. Even then I'll expect they'll say you didn't mitigate your losses - you could have collected from store, had a Saturday delivery and so on.

    I'm not sure you're going to get far with this one, maybe £50 as a goodwill gesture.

    If you didn't keep an eye on the time and missed work I don't see how that's Asda's fault - you have a duty to mitigate your losses, which would for example be contacting them when you had free time next, not when you should be in work.

    If you'd have contacted them another time and not missed your shift, they could perhaps have fitted the re-delivery around your work so you'd not have to incur any costs - unfortunately not watching the time isn't their fault.
  • Hi, I had a late delivery from o2. I have followed the advice and sent a letter complaining and requesting compensation. My total claim for compensation was £247. The letter I had back from o2 simply said they will credit my account £18 (to amount of my bill).

    Would anyone recommend negotiating for nearer my original claim?

    That depends if the £247 was a random figure plucked from the air (money for inconvenience and stress etc) or actual provable losses, and also if you took action to mitigate your losses or not.

    With the information at hand, no one can advise your next course of action. That's like asking a doctor to diagnose you over the phone by telling him you have a cough.
  • I have ordered all new kitchen equipment from Currys that was booked in for delivery on the 26 January, written confirmation. I called at 2 pm to check on a time and was told "not coming today but on the 29th!". I was very calm and explained how we had ripped out our oven, microwave, hob & hood and so had no cooking facilities. She replied how it was our fault and should not have done that, I explained they were collecting the items to recvcle and their terms say the items have to be ready for collection. They were in the front garden waiting. I asked for compensation and that we had to order take away for the next three days. They agreed verbally but awaiting written confirmation. Sounds fun but I think I will get fed up with rich fattening food by Thursday.

    I've had a terrible experience with Harvey's. They were over 2 weeks late with the expected date and then they never turned up on the day they had confirmed with me. As a result, I had to take an extra day off work. They have offered me £100 compensation but I've claimed for £166 - made up of loss of earnings and to compensate for lack of enjoyment. They've rejected claim by stating the following:

    Unfortunately, Compensation is not mandatory and is only offered as a gesture of good will, when an amount is offered we feel that this is a fair amount and is not negotiable.

    If you still wish to dispute this, I strongly advise you seek further advice from the Furniture Ombudsman.


    They never bothered to contact me to let me know that the initial delivery date would be longer, I found that out by ringing them for something else. And then when they failed to deliver, it was me calling them for updates and no one calling back when promised. Where do I stand with this?

    I am sure that will help.

    How did you quantify your "lack of enjoyment"?
    You can only claim for losses... but read that article.

    Thanks for your reply.

    I read that and I used parts of the template to respond to Harvey's. You can attempt to claim other compensation, due to lack of enjoyment (if it's a comfort item) and inconvenience.
  • On 31 December last year my elderly parents ordered in-store and paid in £1000 full for a chair and settee, delivery and insurance.

    Three failed deliveries later they finally managed to get the goods at the fourth attempt.

    At no time during the failed delivery times did Harveys contact my parents to say there was a problem(s).

    At the time of the failed deliveries it emerged that the furniture wasn't even in stock.

    I called them to complain and was told they would get a delivery charge refund and £100 refund because it was 10% of the total.

    When I asked if I would get £200 for a £2000 order the answer was yes as it was 10%

    For one missed delivery it's still 10%.

    They do not take into account the number of failures, just the initial order value.

    My question is: is £100 the going rate for 3 missed deliveries?

    I have read the template late delivery letter and am not sure if it is three separate breaches of contract or one.

    Any advice would be gratefuly received.

    Whats the inconvenience?

    Would the parents have been in anyway? Was anyone else needed to be there at the same time?
