Shop saying can't have a refund the following day..??

  • My local CEX allows you to try it out for 48hrs and if you don't like it you can bring it back
    They also allow you to try the phone out then and there in the shop , show it working and let you have a go yourself if they aren't too busy It's definatly worth doing that next time.
    In the meantime if the shop won't budge on a refund (they may be more flexible if you buy a different phone from there at the same time) pop it on ebay, may even get more for it that way :)

    Yeah i was having a look for what they sell for on eBay. There's quite a range actually.

    It's a Blackberry Curve on Vodafone that he bought. He paid up £120 for it.

    Looking on eBay, it seems he'll likely either cut even or take a small loss, but it's better than £120 sitting in a drawer losing value.

    Op, have you tried to ask for a credit note? It may not be their policy, but if you speak nicely to the manager you may be able to appeal to their good nature and they're more likely to offer a credit note than arefund.....

    My brother was able to sell it on eBay in the end. He took a loss, but at least he no longer has a phone he doesn't want.

    The story doesn't end there though:

    Goes to a phone store in the local market for a Nokia N96 at £110.

    He said this guy doesn't like giving out receipts. I tell him that he has to (i don't know, but some people don't know what they have to or don't have to, so if you don't try it on you wont get)

    Anyway, he gets his phone & receipt. He asks if it's unlocked (as it's 3 branded). He's told it'll take a Vodafone sim, an o2 sim yada-yada-yada. It also has a free sim in there too.

    Gets it home (this is HIS mistake for not trying it in the shop! Even though the guy told him it'd be fine), puts his Vodafone sim in ..... doesn't work. No free sim either, although he's not bothered about that one.

    So today it's off back to the shop & trying to get a refund as it's not what the guy said it was.

    I've told him he should just buy from a proper store.

    This is why I don't like 3. If they find out that someone has unlocked a 3 branded phone, they will lock it again to 3. The guy in the shop may have thought he unlocked it but the unlocking never stays. In CEX, we had to refund quite a few of these phones because of this (they had only just started doing that) and if it is 3 branded then we only sold it for 3 network.

    This is what annoys me about mobile telephone companies. The telephone has been paid for but the supplier won't allow the buyer to use it as they please. This has got to be restrictive practice and should be challenged.

    Really? Is your brother that flipping insane? Buying a mobile telephone from someone in a market who refuses to give receipt and promises him something that, with a little research, everyone should know is not possible, without paying the network their extortion tax.

    The guy was in the right. There is NO legal requirement to provide a receipt apart from a few specific instances such as for VAT purposes (one example)

    I was only correcting an erroneous statement that a receipt was a legal requirement, not making any judgement on whether to buy from a person who didn't supply one.

    How many people buy stuff off market stalls without getting a receipt?

  • Firstly CEX policy is that you can have a refund the next day and they normally give you the full cost in vouchers. I bought a phone (very expensive) and then it was not compatible, so I went to get a refund. their policy allowed me to get vouchers and I exchanged it for a phone.

    All the CEX shops except Nottingham are crap, Nottingham understand the policies and grade the phones correctly.

    Donot expect to get cash from CEX stores are they have a policy of not giving cash. I often used to loiter around and when CEX used to say we got no cash, I would buy the phone off the seller. I bought a N95 black for £65 cash from the punter when it was worth £100 on the street and £145 at CEX, sold it for £100.

    As for a receipt with CEX, the law states proof of purchase, I understand this to show that you bought the item from the shop. The IMEI of the phones at CEX are logged on the computer so they can easily recover the record on the computer.
