One for my brother.
He bought a second hand phone from a shop yesterday (Cex in Preston if anyone is familiar?).
Anyway, he's had 2nd thoughts & doesn't really like it once he's used it & got around it's workings.
The shop tell him there's nothing they can do as it's. 2nd hand phone.
Is he entitled to a full, partial or no refund?
The phone isn't actually faulty.

No refund, even if it had been new. If there is nothing wrong with the phone, then there is no legal right to a refund.0

Under the SOGA, there is no right to a refund or replacement for an item you've bought in a shop, just because you've changed your mind. However, some retailers' terms and conditions do offer a refund/replacement policy, but this is in addition to your statutory rights. It depends on what CEX's refund policy is.0

Your brother has bought something from a shop, not borrowed it from a library !!!!
Of course he isn't entitled to any sort of refund, unless the phone is actually faulty.
Tell him to grow up, put it down to experience, and next time research the item he's thinking about buying, and properly make his mind up before he buys something.I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say.0 -

Actually, I think there was !! When people think they can buy stuff, unpack it, try it, then take it back, it affects the profitabilty of the retailers who ARE good enough to offer refunds. That means that they are likely to raise their prices to the rest of us, so it affects everyone.
Once upon a time, M&S were considered an exceptionally good retailer, because they would give a refund on returned items, even if the buyer had just changed their mind.
Now it seems that folk EXPECT this privilege...I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say.0 -
