    I will give you the index number of my motor so you can send me a scam invoice, would that make you happy? Or shall I park in a disabled bay with a large van without a Blue Badge in one of your car parks? if you do court as I am disabled under the terms of the Equalities Act, 2010 you would then be guilty of Direct Discrimination, especially as any CCTV will show I am disabled., so are you game for it? I need some compo to fund my Christmas excess...

    Ryman999 will doubtless notice that I post rarely, and only once on this board. But I lurk here for two reasons: one, that I have responsibility for a significant site where there is always the possibility of trespass; two, because I received a charge notice on an occasion when my car was parked properly and fully in accordance with the (take my word for it) confusing signage.
    The flurry of letters I then received was intimidating. I am used to legal documents. Professionally I have a legal responsibility under statute law which is always subject to enquiry, even to judicial review. But even I found the documents, with their wild threats of trashed credit ratings and bailiffs, intimidating.
    I know perfectly well that PPC will win a few cases in court, and that others will win against the PPCs. Overall the PPC industry does not take people to court because they cannot win. The industry is legally flawed. And they know that it is legally flawed, which is why the umbrella organisation is fighting to overturn a principle of contract law in a manner which would return the legal system to the era of witch trials.
    Having ascertained (not just here) the true legal position with my charge notice, and taken the view that a company which spewed out semi literate legalese hogwash based on self contradictory signs is unlikely to have a fair and independent appeal process, I decided to ignore the letters. The parking company is welcome to take me to court. I trust the fairness and independence of the court.
    I remind you that I have responsibility for a significant and fragile site. I am not a pseudo Dale-Farm squatter cocking a snook at authority. If landowners want to protect their land, they must fence it. If shops and retail parks want to manage their car parks they must put up barriers. Inevitably their business decision to provide ample parking will be abused from time to time, but not to the point that Sainsburys, B&Q, Odeon, McDonalds etc will go out of business. Relying on companies which operate on a combination of ignorance and threat is not acceptable. That is why, while I sometimes regret the gung-ho attitude of some on these boards, I salute their work.
    Finally, for the avoidance of doubt, I have no intention of posting further on this matter.

    @ ric3vic Barriers with explicit T&Cs on entry are fine by me, a good example is the Bay View Centre in Colwyn bay, where you get a ticket on entry, you have 15 mins before needing it stamped, and the first 2 hours are free, no PPC needed. Unlike the Parking Eye debacle in LLandudno on Mostyn Chempnyts and Parc llandudno

    I am new to the MSE forum and just wanted some well meant advice, thank you to everyone who has tried to give me some advice.

    ....I have slightly lost my bottle, due to the threat of legal action... I dont want people turning up at my house? and now the differing advice means I am losing my confidence. Is it worth me being dragged into court to lose due to bad advice or just pay up (which I cant massively afford at the moment).

    I am going to look into it abit more. I originally thought they couldnt take me to court as they have to issue it to the person who was driving at the time and can not prove that it was me? being the registered keeper isnt enough?

    Im sorry but I am a total novice at this :/

    You are not the driver, so you haven't done anything wrong, no criminal law has been broken, they would need a Norwich Pharmacal Order to try to make you name the driver, Schedule 4 of the Freedom Bill isn't law yet, if it will be at all, you should ignore their invoices and threatOgrams. This is NOT a S 172 notice for a GATSO where the RK is obliged to name the driver or get a fine and 6 points, even if the PPC scammers would like you to think it is imho. I would ignore them myself.


    BTW there tends to be banter when PPC trolls post about successful (not many) cases, which are usually undefended default judgments, possibly with ppc shills taking the rap

    They have half succeeded as fear is their weapon, and contact with them is like a trout snatching that worm on that barbed hook
  • Op, don't sweat it. As you may have guessed ryman999 is the boss of a pipsqueak private parking company who hangs around here because he has no other mates. He has been "trolling" for years like this and would be delighted if you were to pay up. The fact is that despite the ramblings of this troll there is only one thing you need to know - these private parking tickets are not enforcable. The parking company you are dealing with has NEVER issued a court claim and you will not be the first. These are the facts, so don't be spooked by a lone troll and ignore and keep your money where it belongs - in your pocket.
