Suspect the case would be resolved before court action, but simple non payment of monies owed would be what I'd be putting on the claim along with my evidence of contact with EON requesting this payment.
I'm giving them till the end of the week to pay me, and then I'll consider sending them a Letter Before Action (essential to prove to the court you have warned the defendant that legal action is likely).
Of course the risk is that the payment may be made at the time you lodge your claim, in which case you'd be out of pocket, so this is where you may have to tread carefully.
Thank you for the correction; it is Money Claim Online. Agree with what you say, and you do have to give fair warning as you quite rightly point out.
As to your last paragraph; I feel the way to minimise this risk would be to point out in correspondance that you intend to lodge a claim if, the funds that are owed have not arrived as cleared funds into your account by a certain day, make sure this is a Friday. You can then submit the claim online anytime from Friday evening - Sunday.:D This demonstrates fair warning and that the claim was not submitted after funds had arrived...:)

I would personally solicit DECC & Ofgem (amongst other relevant bodies) before going any further and ensure that my local MP is copied on all correspondance with these bodies (whether this is any use depends on who/how good the particular MP is ... so most would be advised not to hold their breath waiting for support:D). In the meantime I would ensure that the energy provider is aware of reasonable administrational costs which are to be levied and accumulated charges to-date and then include a running summary total in all further contact.
If there is no satisfactory movement within an acceptible period then I would look to issue a written final request to them detailing a reasonable payment deadline before legal action is started and ensure that they are in no way unable to misunderstand that this is a final demand.

You may well be and, probably are correct. Very fickle subject. I think that my investment in a generation plant that I have contractually agreed to supply Power to a Power Generation Company, constitutes a business to business relationship; I may be incorrect ? For E-On to defend a single claim would cost them say - £500 (sending a representative) or use of Council - (£3K) ? They may lose; so are risking £500 or (£3K) + £35 + plaintiffs expenses + what is due + loss of reputation; for the sake of paying what is due plus the £35. From what I understand of the 'small claims track' is that the expenses you can claim are minimal, (travel costs) and does not include representation fees. I think it is worth an individual gamble. Sent my letter of 'Pending Legal Action' to E-On last night via e-mail. Phoned them this morning to confirm receipt. Spoke with a polite young lady. She apologised for the delay; confirmed I was on the new system and processed my payment for me as we spoke on the phone.....Case Resolved and Closed..:beer::T Guessed it would be an 'Open & Shut' case.:rotfl:2.5 kWp PV system, SSW facing, 45 Deg Roof. I have today received 3 letters from E.ON concerning FIT payments. First one inexplicably showing (identical) reading on 31 March twice and no payment due, the next showing the reading between 1 February to 31 March at the old rates and amount of generation payment, and the 3rd the readings between 1 April and 1 May under the new rates. Note saying that payment will be made within the next 11 working days.
As long as this happens, and continues to happen within a reasonable timescale, I am happy. Although am still presenting the Statement of Terms as an unfair contract to the Office of Fair Trading.

Well done!:beer: I think what is meant by the wording of the contract, is that E-On want a reading every 3 months; if the first payment was started being > 2 months after you submitted your reading, then technically they would be obliged to always pay you > 2 months following the submission.
