    Well we called the court today to get the details for the cheque. Basically, because the cheque is from the Royal British Legion we don't need to wait for it to clear!!! We rang the RBL and gave them the details and they are going to send us the cheque at the end of next week!

    We've also booked our appointment with the court, and are going bankrupt on Wednesday 13th April! A fortnight tomorrow!!! I can't wait to get this sorted.... also very nervous as well! :o :j

    Excellent news Jumanji.

    Try not to be nervous. You will find the Court Officials very understanding. Unfortunately, this is "just a job" to them, so all they want to do is to process your Bankruptcy Application efficiently and in accordance with the rules for Court procedure. You will be "in and out" before you know it.

    I am very pleased that you've been able to sort this out. You will soon be starting out on the "rest of your life", free from debt. Terrific! :)

    Do we need to get suited and booted for this appointment. Other half thinks we will because it's at court. But I thought we could just turn up in casual wear.

    There is no formal dress code for County Courts that I'm aware of except hats off in the Judge's chambers (office) or court room.

    It can only be to your benefit, however, to give a good impression and not dress down too much. There are certain things which it is advisable NOT to ware though - diamond rings, heavy gold and Rolex's :rotfl:

    Final note: In some County Courts the applicant (Petitioner in Bankruptcy) does not have to go in to see the Judge if the case is simple and straight forward. The bankruptcy clerk, who checks the forms and takes yer money, gets the Order 'rubber stamped' by the Judge while you sit in the waiting area.

    So, deep breaths, relax, don't worry, be happy :j

    I am switching between being incredibly angry and bawling my eyes out at the minute.

    We've just had our landlady drop a letter through our door with a Claim Form for Possession of Property (accelerated possession procedure).

    Let me give you the backgroud.

    Our landlady gave us the required 2 months notice to move out of the property on 10 March as she is apparently selling the property (although we've now found out that she is moving back in).

    We looked at going to a letting agency to find somewhere else to rent. The trouble is no letting agency will help us. Bascially we're going bankrupt so their insurance won't cover us.

    We looked at going private. The trouble with that is 99.9% of all the properties pricately rented will not accept DSS. As I'm on Incapacity Benefit and Income Support, and we're applying for Housing Benefit, this rules us out!!

    So because of all this, we've gone to the council to register for housing with them.

    We've had two meetings where the guy we were speaking to said they would not help us as "we're both fit and healthy" (yeah right) and "we're not pregnant/having a baby". After the second meeting I complained to the council and our local MP. Our MP has written to us, and he has written to the council asking what they're playing at. The council then confirmed that they hadn't processed our application (3 weeks after submitting it). They have now done it but we haven't been informed of anything.

    Then we received a letter from the guy we had had the meetings with stating that we have been given "Notice to Quit" due to rent arrears. I wrote an email back stating that we have informed him quite clearly on two seperate occasions that we have been given Notice to Quit as our landlady is selling. They still haven't done anything.

    At the second meeting with that guy, he told us that one of the only ways we could get any action taken is by staying in the property when the tenancy agreement runs out. That way our landlady has to get a court order to have us removed.

    We don't want to do this, but thought that the least we can do is give the letting agency a head up, so we sent them an email saying "This is what the council have told us... blah blah blah...". Hence the court forms put through our door today.

    I don't blame our landlady for doing this, we don't want to be doing this! But I just feel like the world is against us and I'm so scared that we're not going to have any where to live.

    The letter from that guy at the council also stated that they can't help everyone who claims to be homeless in Fareham.

    OH's parents live in Eastbourne, my parents live on the Isle of Wight. OH has a job, and so we do have ties here. But we've got no where to go.

    I just don't know what to do anymore, and part of me is so tired of fighting and just wants to give up.



    Just spoken to the council, basically due to government guidelines they won't be able to go anything for us. According to the government guidelines people with children or who are pregnant will get housed before us.

    Now that's fare enough, I would never want some kids to be living on the street simply because I was before them on the list. But surely they could ge their priorities straight. Wouldn't it be better it:

    Housed families (pregnant, with kids and people with disabilities) who face homelessness.
    Housed everyone else who face homelessness.
    Housed families (pregnant, with kids and people with disabilities) who needed bigger/better housing.
    Housed everyone else who needed bigger/better housing.

    Just phoned a couple of letting agents who confirmed that they will not help us, as their insurance will not cover us!!!

    So now I've got to persuade those private landlords to accept the following:

    - My partner is working, and I'm on incapacity benefit. So we are DSS, but half of us is working (does that makes sense?)

    - We're going bankrupt

    - We've got a puddy tat

    - We have rent arrears


    I just don't know what to do I've had enough!

    Some landlords aren't keen to rent to people on Housing Benefit. This is particularly the case in Central London. Your local Housing Advice Centre may have a list of landlords willing to let to people on Housing Benefit.

    Sorry that is a copy and paste from a website - is there any chance that maybe your area can advise on who would???
