Fully endorse what Maggie has said.

We are due to meet with the MOJ in next 6 weeks or so from Legal Beagles and this case will be one of my serious concerns which I will put to them as it has always been my contention that monies paid upfront which are returnable as per their T&C's should be held in a separate client account until such time as the claim materialises. They should also be regulated by the OFT as well which is more stringent.

I have just on LB had one lady receive back after paying 20 months ago £3k to Lifestylestyle claims. Until she started to complain 6 weeks ago that they had not updated her. She found that there was no claim and they had her held on to her money for no reason. I can say now that this has been paid back as of yesterday but it took 26 days from them agreeing to actually pay her.

Another lady who paid to Consortium another CMC is in a similar position and the TS are investigating her case and that is a little over 9 months. I fully suspect she will also get her money back as well.

The rules of the MOJ are very weak in places and it takes a lot of complaints and percipherience to get them to close these CMC's down. But you all have to remember it is not entirely in the MOJ's interest to close them down as they earn money from their authorising them and a percentage of their turnover. Which if you think about it makes them party together with the CMC.

Things will have to change for the future and fast as I see a lot more companies folding like Cartel did as well owing millions.

May I take this opportunity of wishing you all the best in your meeting with the MOJ, I fully endorse what you say about them milly88.

A further update to my situation. Received correspondence from my Bank today, regarding their investigations as a result of my wish for Charge Back. Result: failed!!

    Quote:
"Taking the circumstances of your claim into account, including the time that has elapsed since the date of transaction, we are unable to pursue your claim further. However, we suggest that if you still wish to query this transaction you contact Charge Right Ltd, who may be able to assist you in this matter"

Oh right and how do you contact them when they don't exist?

    :(

    Thanks for the responses.

I decided to contact my Credit Card and Debit Card company and pursue a claim against Charge Right for "not receiving the goods or service".

I am still waiting to hear back from the banks.

A company, now calling themselves TFS or Total Finance Solutions, are now calling! They are aware of Charge Right ... "they went into liquidation" is their answer!
No they didn't, they voluntarily surrendered their licence, taking every clients money and documents with them.
Charge Right Ltd have also refused all registered mail ... but strangely TFS, also Swansea based, seem to be now calling Charge Right customers!

Many thanks Pariah for posting this little gem up, I hope you dont mind but have copied and posted it on Legal Beagles section for CMC's so that more people can know what is going on. It always seems to stem from Swansea these CMC's who do not always act appropriately.

That's no problem milly88, glad to be of help, but I haven't been around for a few months ... strange though that I was called this afternoon, about 16.20 by a company called TOTAL FINANCIAL SOLUTIONS ... well, well ... and didn't I tell them a thing or two! Nice young lady, but she claimed to know nothing about Charge Right and was astounded when I told her the truth!!! So ... The Swansea Tricksters are still operating.
