    My point is if you went into a supermarket, and notice you have been undercharged on an item by £5, would you go back in and pay them the £5? The majority of people would probably not. At what point does it become immoral to not go back and settle up?? £10, £100, £1000? How many users on here rang Tesco, or Argos on a pricing error and drew their attention to this? Very few, if any, yet everyone offers thanks etc to the OP for pointing out the mistake.

    If you purposefully went to Tesco to take advantage of an obvious pricing error, or to use a voucher and not buy the goods, then surely this is definately immoral (and possibly illegal).

    Just my opinion on the matter.

    Perhaps much of the advice has been merely pragmatic. A £5 undercharge in Tesco would go unnoticed, whereas this dealer is going to notice his missing £3 grand odd pretty quickly. As the payment can be taken at any point in the next six years (and without warning in the next six months) it would appear prudent to pay up sharpish to avoid spending the money and having it debited at an inconvenient time.

    I'd always advise someone to be honest regardless of amount owed but then I'm a bit self-righteous like that. But speaking practically and pragmatically, there are differences between a small undercharge on a large shopping bill and over three thousand pounds.

    TBH, I think the OP only got a bit of stick once he or she started saying 'but it's the dealer's error, his problem, tough'.

    So if the dealer added an extra 0 on the end of the balance and your dad paid it and realised after would it be your dad's fault and tough?

    Could the dealer keep the extra money?

    To be fair, most people are having a go at the OP for MSE being her first port of call, and not instantly going back to the dealer.

    Well I'm sure there's been plenty of instances where someone has been overcharged and they've posted on MSE first.

  • All i came on this site for was for some legal advice about the problem we had and asking a simple question, and all i have had is abuse at me. one being about my grammar, i have dyslexia why i'm defending myself i don't know, i should not have to. but that did not stop me getting 6 o'levels,3 a'levels and 2 degrees. for the people who actually helped me, many thanks all has now been sorted and the balance paid, which was going to be paid as i said before. for the people who had a go at me, need i say more.

    Honest question. If the dealer had charged you £7000 and refused to give it back because of a loophole, would you think this was acceptable?
