If there was not a loophole, hand on heart I wouldn't use it.
If however there was... well, why would there EVER be and for what purpose? People supply credit to people all the time, but if you agree to services at a price then you have to pay the price -- whether payment has been made or not.
I'm shocked you even think it's acceptable to want to screw them out of thousands of pounds! What on earth makes you think it's okay? How would you feel if it happened to you?0 -

If the car company over charged you, then you would be straight round to collect the over payment. Therefore shouldn't you just go round and pay what you owe them? They may offer you a guesture of good will for your honesty and being up front but its what you need to do anyway. If not they could just take it out 100 days later when you need the money for xmas.0

it was an error and the seller can take the money back so its easier if he called the dealer tomorrow and explain what happened and offe rto go and pay the rest rather than a onth down the line the is taken and yhes wondering what the amount is for. He could have said something when he was there.0 -

its obvious where 1 stands, if it happened to me(touch wood its not happened yet) id be honest with the seller and explain that the correct amount of money wasnt taken from the account.
Think of it if you were the seller or dealership owner, would you be happy if 1 of your sales staff sold a car or a white good for less than the actual price ? would you not look to recover the remaining money ?0 -

Whether this was legal or not wouldn't change the fact yours action would be unethical to selfishly see somebody out of pocket of such a large sum because of a genuine mistake.
Even if something was legal, doesn't necessarily mean it is ethical. Criminal law + a good (and expensive) lawyer is one example of this.0 -
Legally:
The seller can claim the outstanding balance
The buyer is under no obligation to bring the mistake to the sellers attention.
