    - they've been testing it since March this year
    - it's not just for ESA [ now ] its for DLA [ future ] when DLA goes PIP
    - many people claim its urban myth, but its fact and staff are being trained in it
    - its in the current [ physical activity ESA guides ] ATOS training handbook

    - if you did you would be one of perhaps half a dozen [ non pro's ] in the country
    - so don't be confused - no one has it !

    I told you the criteria and others have also told you, why are you confused?

    You will never see an ATOS handbook, no one will but there is plenty of correct information on the web (including the virtual wheelchair, its been very well documented)

    Your dad needs help with his appeal, some wheelchair users work and the goverment are "being fair" to us wheelcies by assuming everyone with mobility difficulties should wheel instead, thats why the virtual wheelchairs (not to fail more people but to be fair to others :rotfl::rotfl:)

    Try CAB or your LAs welfare rights bod to help your dad, I dont think you are going to be able to help him but we can help you if you have specific questions, just start a thread.
  • 12mth rule starts April 12 2012 (I think). Government are trying to limit ESA Work Related claims to 12mths but the horror of this is they want it retrospective ie it applies to ALL claims so if you've aready been getting it for 12mths your claim stops.

    I assume you can then claim JSA or Income Support but if you have a partner who works then you'll get NOTHING! So how many marriages/partnerships will then breakdown?

    For example - two people live together - not married - if they seperate neither one can claim maintenance from the other - neither can claim a tax allowance for the other. Yet the benefit system assumes one will provide financial support for the other without question.

    I get ESA support group rate but wonder how long it'll be before they start on us? Or do they assume we'll die quickly?

    and the critera for the 15 points is... cannot mobilies more than 50 meters on level ground without stopping in order to avoid significant discomfort or exhaustion.

    so your wrong by saying they assume you have a virtual wheelchair
    You need to read the form as it is written.

    mobilising unaided by another person with or without a walking stick, manual wheelchair or other aids if such aid can reasonably be used.

    So even if you do not own a wheelchair, the ATOS doctor will assume you can use one unless you provide evidence to the contrary.

    In 2016, following a debacle around their performance, Group 4 lose the contract for carrying out work capability assessment, and the law is changed so that people get benefits for life. The contract for overseeing this is won by Dignitas.

    It states this about imaginary wheelchairs (possibly says more but this should give you the gist)
    A manual wheelchair may be considered any form of wheelchair that is not electrically driven.
    In this activity, the HCP should consider whether a person could potentially use a wheelchair regardless of whether or not they have ever used a wheelchair.
    In considering this issue, as above, upper limb function and cardiorespiratory status must be taken into account.
    When considering mobilising, the concepts of repeatedly, reliably and safely must be taken into account as detailed previously.
