    I very much doubt that it was a genuine mistake and the salesman was under pressure to make a sale. Sealed items are not opened willy-nilly, just to show customers what is inside the box. I am pretty sure there are contractual agreements in place with the wholesalers/manufacturers about breaking seals prior to sale.

    Well we don't know if it was a mistake or not.

    If it wasn't then it still shouldn't give a legal right to compensation. As I said before, if this was the case, every tom !!!!!! and harry scumbag will be abusing it. Current enforcement powers (ie fines ect) will be much more effective.


    But this could have easily have been an error by the salesman for reasons already mentioned.

    I still think you would get a much better response without the need to telling them of your rights. I'm sure others would agree..............maybe................?
  • I get the laptop exchanged tomorrow, i hope i will get a small discount or some credit as a sorry for the inconvenience but that will be up to them

    I am awaiting consumer direct to contact me, i phoned them but only spoke to someone that said they were basically an answeing machine and someone will call me back. I will tell them what happend and if it is one of many similar alegations made against the store i guess they will use it with all the others to get their wrists slapped. or they will have never heard anything like it before and i will be happy that it hasn't happened to anyone else that could have had a far worse time than me.

    acron the mistake part of the quote you posted just sounded like a get out jail free card i bet there are lots of claims it was a mistake. i gave up driving ages ago.

    esqui - my laptop had been set up 6 weeks prior and put on display. at some point it was then put back in the box and a note stuck to it saying only opened for customer viewing never used. things like that sometimes just happen ;-) what happened to the laptop you opened by mistake?

    i quoted SOGA so they know i know the exchange isn't something they are doing as good will, they have to its the law and my right (am i right?)
    i quoted TDA as they could have breached it (if it wasn't an honest mistake) so they know i know it could be a criminal offence (perhaps)

    i have said i'm very greatful that they are exchanging it but i feel that a good will gesture would make me happy about using the shop again. and i probably would as they are quite well priced for lots of things and you don't have to worry about couriers turning up between 7 and 7. just next time i wont take their word for it if the box looks tampered in any way.

    but if consumer direct say this has happened before i will certainly not go back and would definitely name and shame them.

    A hell of a lot of hassle for something that has no fault. when I sell a laptop I ask the customer do they want to see it out of the box before leaving the shop.
    I try to insist that the customer view it, at the least for everyones piece of mind.
    Sometimes if there is only one brand of a model left that was on display, I sell it, although in my shop it has never been turned on.
    I dont see that the retailer was any way at fault here, and your just clutching at getting some rewards for forking out £1000.
    I dont see how thet inconvenienced you they have already said sorry.
    Enjoy your laptop and stop moaning.

    Yes you are right. You could have also rejected it for a full refund.

    Perfect, that's what i've been getting at all along.. I think by appealing to their better nature rather than quoting rights, the person is more likely to respons with a positive attitude.

    I really fail to see how could come to that conclusion. Surely you don't open sealed goods, just to show prospective customers what they look like?

    The fact that the OP had all the hassle of having to arrange for a replacement would be quite inconveient.

    I think Argos do this aswell if you go to the customer service desk and ask to see an item?
  • visiondvd - i'm not moaning just trying to get advice.

    i think they sold me the ex display cos there was no others in the shop. only problem with that is had i know i wouldn't have bought it. the display models aren't in a glass case they are on 12 hours a day 7 days a week with anyone being able to test the display models.
