A Warning - CapQuest Debt Recovery!

    I am new to the site and not looking to hijack somebodys post but cannot find out how to start a thread.
    My problem is this I have quite a large sum of outstanding debt which I had an iva for but I have been made redundant and my iva has now failed I have tried to pay back what I owe but I now know this is not possible and now survive on benefits one of my debts is to capital one this is where Cap Quest come in I have had a letter instructing me to pay the outstanding sum £3000 or set up a payment plan by the 9th July or they will pass the matter to H.L Legal instigating legal action does anybody know what this means if I could afford to declare myself bankrupt I would, I have no savings I have two daughters to look after and like most people in my position have no spare money does legal action mean they will make me bankrupt I am worried sick I don't know which way to turn can they instruct bailiffs to enter my home and take the little furniture we do have. could somebody please advise.

    Anyhow to get to capquest they are threatening legal action in the form of a ccj and they have sent me a letter telling me how bad it will affect my life i have nothing to pay them with if they win a ccj against me and i dont have any assets and i now live in a council house i have not even got enough funds to declare my self bankrupt i dont know what to do i feel so scared, my ideal was to have continued working and pay my iva off but this did not happen can anybody offer any advice.

    If you are on benefits, then you don't have to pay. the money you receive from the government is protected (as the law states that the given amount is what you need to live on) So contact them and inform them of this. they will soon leave you alone :)
  • New to posting, but been reading the advice on here for some time. Just got a letter from CapQuest this morning about an account with the Northern Bank (no acc number provided). This debt was never settled, but is 12 years old. Haven't heard anything from the bank in 10 years. So called up capquest, quoted the law at them and informed that as I am currently in receipt of state benefits, they can't touch me. A "Mr Campbell" was very unhelpful. He did admit that their sister company had sent me a letter 6 months ago asking if i lived at a certain address in the town i grew up in. I nicely told them I didn't, and that was that. Now they drag up some old debt and try to charge me for it. Was quickly fobbed off with then old excuse of "there must be 2 people with the same name". Well, I have a very unusual surname, I lived in a town of about 5000 people, and i was the only person with that name. Despite me admitting knowledge of the debt, and that they got my name and the town i grew up in correct, "Mr Campbell" still tried to use the get out clause of "2 people with the same name"

    Anyway, thats them off my back. Absolute shower of idiots. I have dealt with a few debt recovery people in my time, but this lot take the prize for being the thickest!

    Every couple of weeks they ring me, I answer and they promptly put the phone down. I don't have any debts I know of, so I answer to try and find out what its about.

    I had 5 messages from them last week all in two hours. i don't have any debts but certainly won't be answering them! is there no way you can block a number from calling your mobile phone?

    Depends on the phone. Most Samsung's have the ability to add specific numbers to a block list on the handset.

    If you don't have that option then there'[s not a lot you can do other than change your number.

    If you don't have any debts why not just answer the phone and tell them to jog on?

    About 6 weeks ago I received a phone call from my son who lives and works in England (I live in Scotland) saying he had received letters from Capquest demanding he pay an outstanding credit card debt or legal action would be taken. Bemused he took the letters to his local bank and then phoned me to tell me about the incident.
    It transpires that the outstanding debt is one that I am aware of, it is a long outstanding credit card bill that I have been paying off over the years. The debt has obviously been passed from one debt collection agency to another and has finally landed on CapQuest's desk where it would appear that they did not have my current address details BUT as I used to live and work in the same town as my son who received the letter, they seem to have just plucked my surname from the phone book, found a match (my son) and posted off the demand!

    I complained via telephone to CapQuest demanding why this incident happened and although I have received an apologetic reply they have not disclosed how or why they decided to just send a threatening letter to another person with the same surname, and in this case, my son. They have advised me to follow up this complaint via the Ombudsman if I require, which I will, but couldn't answer my questions on the way this situation has been handled. I was going to leave it at that and set up a payment plan but on finding various websites with numerous complaints about the company I am standing fast.........

    Can't say I am surprised with them.

    They aren't frequently referred to as CRAPquest for nothing.

    Carry on with your complaint. Also may be worth just dropping the OFT a formal complaint over it as well. enquiries@oft.gsi.gov.uk They can't act on individual complaints, unlike the FOS, but the OFT are currently the ones who can take more serious action against CrapQuest if they get enough similar complaints through.

    Capquest Debt Recovery (01252 765156) are aggressive, unprofessional and down right intimidating.

    Do NOT deal with these people and certainly never ever contact them by phone.

    Thanks to others on this forum and this forum altogether people have been able to deal with them and if any of the experiences by others on here help people then it is only a good thing.

    I received a call this morning at 8:00 (not particularly early granted) but they had no reason to call me! They were looking for my partner and called MY mobile number!!

    In fairness it wouldn't be easy to find my number as I am a business owner and it is published everywhere along with our address but this is the type of tactic they will use to contact / trace people.

    Please Please Please anyone else who is having trouble or getting harassed by these people use this forum for help and advice.
