    thank you hermum sorry folks just upset about this I hate things like this and I'm a really nice person and hate upsetting people at the best of times and sorry if i'm confusing anyone :0(

    If you have to refund her it's a lot of money, I'd be upset.
    It does just sound as though she's a nasty piece of work.

    Yes, ebay will tell her to return for a refund unless they do a no fault refund, they refund you & she gets to keep the goods.
    The return postage will be down to her.
    I'd want pictures of the damaged items.

    On the plus note of money saving I'm doing really great so far this year just saved another £40 on my car insurance and made £150 (without this sale) on ebay by having a clean out of stuff :0)

    ok -sorry, im going to add another twist to this....if the buyer is instructed to return it, is it best for the seller to organise the courier as they will then have the tracking info ?
    im just thinking that it may 'go missing' or pieces may become damaged on return ?
    if something does go wrong on return then where does the buyer stand ?

    No the buyer has to arrange and pay for the return. If it gets lost on its way back then the buyer won't get the refund and will have to make a claim from the courier they used.

    yikes what a horrid story. sounds like a real chancer who knows all the ways to screw a decent seller. as for the belated "breakage claim" - i'd doubt that occurred en route, but she may cause it herself to crack you. (excuse the bad pun). did she have many ratings? best of luck
  • she is a nitemare :o she's got a negative for selling a fake phone.

    I've spoken to ebay this am and was told if I offer refund after service is returned she has to pay for the courier so sent her this (and asking for photos of the broken china) so will just wait and see now :(

    after waiting 3 days for her to rely to me she's now saying she doesn't want to return it but if i will refund her some money 'everything will be fine'
    still not got photo's that I asked for (so say broken plates) I'm willing to wait it out and keep pushing her to return the lot for a refund , what do you folks think?
    oh and I thought the case was 10days but it now says 8 days? have they changed the rules in the middle?
