Non Fault Accident what rights do I have?

    I am entitled to one on my insurance but dont want to get them involved for fear my insurance will go up as it did the other year.

    You will still have to declare this accident, so I'm not sure it makes any difference (you can check by trying quotes).
    I dont want to costs to be inflated

    I understand your desire, but you don't have a choice about what future insurers want to charge.
    You can either reward one that doesn't increase your premium as a result of the accident by giving them your business (they might not be the cheapest quote) or claim it back each year from the liable party.
    I just want car fixing, my insurance doesnt go up because of this

    Are you certain? You are aware you still need to declare it aren't you?

    If you don't want to leave all this to your own insurer and claim off your policy you can either sort this yourself (put in a quote to the third party insurer, state you hold their insured responsible and ask that they agree to reimburse all your costs, then take it from their reply as how to proceed - but you could well end up paying for the repairs first then getting reimbursed) or use a claim handler to sort this for you - assuming liability is clear cut.

    Yes I am ware I may have to declare it to my insurance, but if my insurance goes up as I already have one strike out of 3 in 5 years, if I am out of pocket which as a result of this then surely I would be compensated from the other drivers insurance?

    I got a quote to see how much it would cost so I gave the other driver a choice she has £400 excess and costs may be £700 roughly

    I want to do right thing obviously and dont want to inflate the claim either, I accept it was an accident although I know its down to poor driving on her part.

    The third party does not have to pay any excess for their insurer paying for your repairs, so this is a red herring.

    You say you need your car fixed by the end of the week, but this is highly unlikely if you have so far not started on getting anything done!

    If you add it to your claim then yes.
    But bear in mind you will have to declare this claim/accident for 3 or 5 years. So you won't know what it is going to cost you until the next 3 or 5 renewals/years.
    If the first renewal comes up before it's settled you can add that to your claim, but the other years, you'll have to put in a claim yourself.

    Her excess applies to her car not yours.
    There is no excess on 3rd party claims.

    Using an accident management company will cost more than writing a letter yourself.
    But if they won't deal with you direct then you may have no choice.

    Just an update


    Reported accident to my insurance, they faxed bodyshop in my town who I went for a quote the other day

    Bodyshop took photos and said they let me know. He did say car may be not worth financially doing. Its a Ford Focus 1.6 LX 5 door and 58k mileage and is excellent condition prior to accident which is scrap on front wing/door

    I got a value of what car up to 1.9k bodyshop guy said 2nd cars have gone down a lot and value from whatcar is over valued

    My insurance said it should effect my insurance at all, I hope so

    When I say end of week didnt mean this week, sorry of that sounded like it does I dont mind it next week or week after, as long as I have car for end of week as thats when I most likely need it. I probably get a curtsey car now thats what insurance company said they probably do for us

    Well I hope so too :-) but be aware that the people who man the phones can't tell you what prices will be tomorrow or the next day, so I am afraid that answer isn't binding.

    True nothing definite thats the problem y6ou canbt say 100% isnurance has gone upo due to other reasons rather than because of an accident regardless of blame some months previously

    I will just have to hope :)
