Non Fault Accident what rights do I have?

  • I'll just wait now for my 3 Estimates to come back to me....will take them to my Insurer & see what they say.....if they agree to my Repairers thats fine....if not it'll go to my insurers repairers....

    I just hope that if my insurer's repairers call it a Writeoff, that I am Legally entitled to salvage it back plus their market value lumpsum.....then I can have it repaired for no more than the lump sum ideally.

    Still can't grasp why it matters to my insurer who repairs it & what the cost is....as ALL the cost is borne by the liable 3rd Party.....as I'm claiming against them, and not my insurer? I thought my insurer would only be like a gobetween here, chasing up what I'm legally entitled to against a liable 3rd party.

    Still don't understand....just like where do odd socks disappear to in the washer!

    It's usually because your own insurers initially cover the repair cost (less your excess) and then handle the claim back from the third party's insurers. Without that you could be waiting for months until an agreement is reached. That's one of the benefits of fully comprehensive cover.

    It is simple, happened to me in May this year.

    I rang my insurance company for information only

    Third party hit me, he rang his insurance company, they rang me, told me to take it for a quote, ( I was within my rights to take it to any garage I wanted, I wanted Main Dealer incase it invalidated my warranty) garage faxed them with the quote.
    They sorted me out a hire car for 2 days, Garage fixed my car. All sorted within the space of 10 days.

    It really is that simple when it is a no fault claim. There is far to much conflictin information on here it can be very confusing at times
    for people with no experience in this sort of thing

  • So is it still possible for me to go down that route?
    I could phone the 3rd Party guy again today....get my 3 Estimates in....get them to his Insurer & if they agree the cost it get fixed at my garage choice?
    And if 3rd Party insurer agrees cost (I'm not bothered about claiming courtesy car for the couple of days car may be in garage.....maybe that would help me as it keeps his costs to me down??) then am I legally allowed to then telephone my insurer back to cancel claim??

    Is that an ok procedure to do....just keep my own Insurer waiting for another day whilst 3rd party agree costs....then cancel my Insurer claim?

    do you have a claim number or something, you could ring the TPs insurance people, not the guy, he has paid his insurance people to deal with things on his behalf so see what they say.

    I Say it happened in May to me, it did, it also happened in June the year before, I had no clue what to do and was rushed into using a claims company, I learned a lot from it. I would never use the leaches again.

    Let us know how you get on, but please, get everything in writing, even if its a fax or email.

  • I have my claim number for my insurer...and the other guy is with Direct Line....wonder if I will need more details fropm the other guy first so that Diretc Line can trace the claim? Do I need his claim number with his company?

    Have had a smallish impact to car rear. Third party 100% liable as too close....work will be new bumper, tailgate just tweaked a little, & something called a rear member under the back is bent over in a place...and we think that's it.
    I reported it to my Insurer, thinking that as a NonFaultClaim, I would simply get car repaired & 3rdParty insurers pay for it.
    I am waiting on 3 estimates to get back to me.
    If my insurer doesn't like the quote, are they legally allowed to get their own repairers in & writeoff my car?
    If so, do I have the legal right to get my car back as salvage, with lumpsum, & so I can get it repaired for that market value sum.

    If my insurer doesn' t like Estimate costs....and so may go down the writeoff route, can I instead contact 3rd Party insurer & if they agree costs, it can be repaired that way?
    Should I chat with 3rd party driver again as have previously chatted with him.
    And if so, can I then contact my insurer and tell them my NonFault claim should now just be logged for information only?

    My car is 9 yrs, 1.1 litre little car, maybe £1000 value now, low mileage & I am fully comp.
    This is my first "accident" after 10+ yrs No claims.

    I'm not interested in courtesy car, medical etc, I would just like my car, good little runner, low mileage, back on the road, No claims intact etc.

  • I know. All the people posting having been really kind. It is all pretty confusing for me as never been involved with car insurance before. Some of the information sort of conflicted, although yours actually was the most hopeful to me of those I received.
    So if I shouldn't post on this insurance bit should I take it off or something. As I don't want to do the wrong thing on the site.

    Hi honeyblue, just go to my last post, honestly, I have been through the same thing twice in 15 months. So I know what Im talking about.
    I was like you on my first 'do' so I know how you feel. I just felt 'why am I getting all this hassle when I havent done anything wrong'
    You havent and it will be sorted, Ring the other guys insurance co. take it from there, get some guidance from them, they are liable.
    Get it all in writing, they will instruct you. Once you have got the go ahead in writing, ring your insurance company and inform them as to
    what has happend and that you want to deal with it yourself.
