Non Fault Accident what rights do I have?

You will get varying views because firstly people have different personal and professional experiences.... you won't find someone who works for an ambulance chasing firm saying that you should claim directly from the third party insurer yourself.
If you do decide to go down claiming from the TPI then first of all check your insurers haven't incurred costs already as these would become unrecoverable if you switched to dealing with the TPI direct and thus make it a fault claim against your policy. Likewise remember you have no protection from the Financial Ombudsman Service if you claim from the TPI rather than your own insurer.0 -
I had my car hit on Friday it was parked on street slightly on the kerb (but not causing obstruction) the street is quiet narrow but very quiet hardly any vehicles use our street let alone foot traffic. The driver a neighbour admitted liability she revered into my car whilst trying to find entrance out of the street. I dont want to contact my insurance as I had the car hit 18 months ago probably same reason reversing and the scum drove off, my insurance went up following year. I dont see why I should have to again have my insurance up through no fault of my own, I have had 10 years NOCD and its protected but my insurance still went up.
I was contacted on Friday by accident management company via a bodyshop I knew they were going to ring so no cold call. They told me if the work it over 66% of the value of the car which I got a rough quote £700 and I got a trade in price last year at a dealer for 1k the scrap car. I just done some research in whatcar web site and value of car is far higher between 1.6k and 1.9k
http://www.whatcar.com/valuations
Dealer £1,975
Private £1,860
Part exchange £1,835
Trade £1,675
I rang the other drivers insurance but they want the driver to ring them, I got there policy number and other details0 -

You do "have" to - you agreed to the policy conditions when taking out the policy that you would inform them of all incidents.
If you don't do so, then you breach the policy conditions, allowing them to void your policy should they decide to!
(And they will find out, as will any future insurer you approach but don't declare this - the claim you are making off the third party insurer will be registered on the CUE database)0 -
There is a chance my insurance may go up, why do I have to involve my insurance its a simple claim the liability is 100% off the other driver.
18 Months ago same problem vehicle reversed but this time I had to claim of mine because the scum decided they didnt want to hang around.
I am careful driver this is 3rd time in just over 5 years I have an an accident when car is parked, two hit n runs and one who did the right thing.
If my insurance goes up on this occasion then surely I have some come back, there is ample room for vehicles to pass my car, the street is unusually shape and you cant do 3 point turns you have to either drive around the whole street to get out or reverse if your near a entrance which I am. The driver reversed the length of 4 semis to get out of.
I been driving since 1982, never had accidents I always drive careful, park to try and not cause issues, park at end of supermarket car parks to avoid have someone hit my car when opening doors, but still get hit.You do "have" to - you agreed to the policy conditions when taking out the policy that you would inform them of all incidents.

See my reply (#24) to your earlier post regarding this.
You have no choice but to inform your insurer, (you are contractually obliged to), and the "penalties" imposed by insurers for deliberately not doing so can be severe and expensive!
As previously pointed out, as you are claiming off the third party insurer there is no doubt the claim will be registered on the CUE database so your non declaration will get found out!0 -
So what if my insurance then goes up because my car is stationary and someone decides to hit it, why is it fair my insurance then goes up, why should I pay more, I didnt do anything wrong, I resent having to pay more when I did nothing wrong.
We all pay a premium for scum who drive without insurance yet in Nov 2009 I still have to £150 pay access and premiums went up, the MIB didnt want to know, I have protected no claims yet insurance still goes up, seems a con protected claims.0 -
Why not claim back the cost from the other party?I didnt do anything wrong, I resent having to pay more when I did nothing wrong.
You are legally entitled to be in the same position as if the accident had not occurred.
Alternatively you could reward an insurer that doesn't penalise you with your business (they don't all penalise you).0 -
Thats what I am trying to do. I got there details but their insurance wont deal with me. The other driver said I do it from my insurance and claim of theirs. I took car to bodyshop and they said a accident management company can deal with it and it wont ever cost me out.
I dont want the cost to be inflated due to accident management I am trying to be reasonable and not have claim costs arm and a leg hell I not even bothered about a curtsey car if I can, but I dont want to pay for more insurance when I did nothing wrong as indeed two other occasions I had car hit first one on a different street, I moved house to live on a quiet street is dead in my area believe me.
I didnt tell other driver off I was really calmWhy not claim back the cost from the other party?

Is this what the insurer said? or relayed from the other driver?I got there details but their insurance wont deal with me.
Are you entitled to a courtesy car on your own fully comp insurance? If so then there is no need to get a accident management company involved.
You don't HAVE to take a coutesy car if you don't want/need one and you don't HAVE to use an accident management company (I bet the bodyshop get a referral fee).
Do you have legal cover?
If you have legal cover then add your uninsured losses (excess and bus tickets etc.) onto your claim.
If you are getting the bus/train then make sure you keep all the receipts and keep a list.
I know it's a pain, but no reason why you should be out of pocket.0 -
I am entitled to one on my insurance but dont want to get them involved for fear my insurance will go up as it did the other year.
The accident management company was notified by bodyshop to which I gave them permission my main reason for doing that was I was told it would costs me anything nor should my insurance go up but I am unsure if thats true. I dont want to costs to be inflated as we all end up paying in end
I just want car fixing, my insurance doesnt go up because of this, I can do without some inconvenience and car off road for a few days as long as I have it by end of week, I need car to take my disabled daughter around if its longer than a few days. I only use car for pleasure I dont do much mileage car is parked on street most days. Car is in mint condition otherwise. I woudlnt mind it but last time door and front wing was hit and had it fixed. I had a new panel replaced 6 months before privately because it had rust bubbling through so its going to have 3 new front wings in 2 years
I dont have legal cover unfortunately I will next time thoughIs this what the insurer said? or relayed from the other driver?
