I am just pleased that we can get the deposit back, I think everyone looks for it cheaper, it is human nature but he kept insisting we could not find it cheaper.

Paid cash for the deposit, no chq.

Well you're being a bit of a prat tonight. As already been mentioned by another poster as its a door to door seller the customer is allowed a 7 day cooling off period. Therefore legally she can change her mind and cancel the cheque if they wish. As such as long as she notifies the company that she has changed her mind under the 7 day cooling off rule and has cancelled the cheque the company cannot do anything.

Victory didn't pay by cheque though and she's entitled to a full refund anyway.

Errrr. Writing a cheque and cancelling it is not the way forward. "prat"?

Not once did you mention about cancelling due to the fact that the contract was concluded in OP's home.

Crumbs where is all this coming from? I will ring up the company tomorrow and tell them about the 7 days cooling off period that no one mentioned to me.

yeah thats true which is unfortunate. I've had trouble with these sort of door to door sales people before and although legally they have to refund the money it can often involve alot of messing around and sometimes its easier to just cancel the cheque and write off £8.

Rubbish. Your advice is potentially very, very dangerous and smacks of someone that really doesn't know what they are talking about.

Cancelling a cheque is very rarely an answer as writing a cheque indicates that that a debt is owed. Again, research "action on a cheque".

Cancelling a contract off trade premises is a RIGHT. Which is FREE to exercise.

No chq involved, we paid with the £50 we had in the house, if we had more we would have paid more because originally before this happened that it was £90 cheaper on the internet we were very happy with the purchase.

I didn't realise that in my post I had to summarise every other posters points and advice before offering a suggestion! I thought it had already been clarified to everyone's satisfaction that legally the OP is allowed to change her mind within 7 days.

Prat was the least offensive word I could come up with! You appear to be very aggressive some could call it unfounded aggression!

Wondered the same. Bit p'eed off being called a "prat" when disputing "advice" given by someone that could have caused civil and, potentially, criminal liability.

Oh, put it in writing to them....
