Found it cheaper elsewhere but have put down a deposit

    Well no that is wrong, no one can afford the extra cost, the only reason we gave him a deposit because obviously we wanted but we did not have the rest of the money to pay him, not at least until pay day in September, I need it to get the mobility scooter in the back of the van, otherwise I am stranded, he said over and over he had the best price, we tested them they were sturdy and strong, just what we needed, no one needs to pay more for something so expensive that we have to wait to afford in the first place.

  • Provided you're within the 7 day cooling off period for contracts made in a consumer's home you should be able to cancel (probably need to phone to tell than and follow it up with something in writing). You will be entitled to all of your deposit back. If they give you any hassle with cancelling or refunding your deposit then contact your local trading standards who should be able to sort it out for you.

    Did they provide you with a notice of rights to cancel at the time you signed the contract? If not then you should call your local TS and report it (to stop other people from being taken for a ride!)

    Out of interest (because we get a lot of mobility company complaints where I work) what company did you buy from??

    No, we were not given any other paperwork than a yellow piece of paper with euromobility on the top, customer purchase order, customer details, deposit of £50 for potaramps 72pcr, total less deposit balance to pay, I signed it, we also have a grey piece of paper with my name and address on it and states- deposit for portaramp £50 that is all that was given, also I signed a vat exempt form.

    They are obliged to give you a notice of your right to cancel - many companies don't because they don't want you to know you have a right to cancel, they prefer for customers to think they are stuck with the contract and part with more money or walk away from the deposit.

    Failing to give you the notice is a section 3 Fraud (fraud by failing to disclose information they are legally obliged to disclose). Contact trading standards and they should sort it out for you and depending on if they've previously given the trader advice before or not they may take some action against them.

    Thank you so much because I really did not know any of this, thanks for your time in replying, very much appreciated, I do feel better that we can get the deposit back and go elsewhere for the same thing much cheaper, we are not rich people and cannot afford to pay a higher price for the ramps, I need the ramps there is no doubt, we have to afford them but we can get them cheaper.

    You're very welcome! Sales people who take advantage of vulnerable people make my blood boil so I'm always happy to help where I can.

    Before you pay to buy anything it might be worth contacting your council's occupational health section - if you require adjustments to your home they may be able to provide them free of charge. I don't know how they do the assessments or what factors are taken into account re: who pays and who gets things free but it'd definitely be worth a call to them! They'll also be able to give you proper impartial advice about what equipment is best for you. Mobility sales people often claim to do 'assessments' but have no qualifications and are really just assessing how much money they can get out of you!

    I know a number of people in my area have been scammed by mobility equipment sellers and it later turned out they could have got the equipment for free or at a drastically reduced cost from the local authority.

    I am waiting for the OT assesment , I am on the waiting list now so should be between 4-6 weeks if not in some cases longer, I want to make sure when they come round they see my needs and see if they can assist, as for the ramps they do not provide, more to do with needs within the home.

    In the meantime the things I need I have been very lucky and got them off ebay and a very reduced price or from charity shops, car boot sales that type of thing, I really feel strongly that you put the word 'disabled' before anything and the price goes up threefold:eek:

    There are lots of things that are disabled usages but can be adapted from the normal ones into disabled ones, there are millions of websites that charge such a huge amount, for eg I had to have new batteries for my mobility scooter, rang loads and loads one quoted me £395, the average is around £75 each, even that is steep but £395:eek:

    Even your comments about deposits are wrong. I'm sure you mean well but good meaning can be dangerous without the back-up of knowledge.

    Again, terrible advice. Read up on "actions on a cheque".
