Car insurance void - advice needed

    Positive news: SW rung today and they confirmed that the what they told me a month ago could be understood as 'dont' put this claim on' and apologised. They will confirm all this to me in writting. They suggested I rung Allianz to let them know.

    Rung Allianz, but they did not want to know. There is now a mark on the Motor Insurance Database against my name. They are sending me complaints procedure. They have 5 working days to aknowledge receipt of my complaint and then a few weeks (??) to investigate it. I gather there is a possiblity that the mark against my name could be removed, but the question is when.

    Also, I asked SW to give me another quote, since I need to use the car. And they will ring me back about it.

    Presumably you need insurance now. (And will have to pay more for it due to this issue - unless you are offered a deal that you are prepared to accept by SW).

    So if your complaint against Allianz is successful, you could ask them to reimburse the extra costs you have incurred, and if unsuccessful you may wish to seek legal advice on pursuing a much larger damages claim against SW for a lifetime of extra costs!

    Wow! Lifetime of extra costs sounds serious.

    Good news! SW gave me another quote even slightly cheaper than Allianz, and I got accepted. All I need to do now is to send them NCD proof (being the renewal quote they sent me before) and a letter explaining what happend since I left them up to now.

    I will still persue the complaint I launched with Allianz to make sure that there are no 'marks' or 'flags' against my name.

    Thank you to everyone for your posts. I am a panicky type, so two days ago I thought the world has come to an end, but it worked out at the end! :T:T:T

    Hi all

    Since my last post a few things happened.

    1. After SW insured my car they asked me for some documents, like copy of dring licence, vihicle reg doc, etc.
    2. I sent all docs twice, but due to some 'God knows what happend', they claimed that they did not receive anything and cancelled my policy.
    3. I rung them in disbelief, spoke to a few people explaing the whole saga again. They phoned me the same day and arranged a new policy.
    4. I wrote to SW and Allianz a long letter.
    5. So far, I still have not received copies of transcripts of my conversations from SW.
    6. SW phoned me yesterday, apologied profusly, promissed to confirm in writing that there were no 'ticks' against my name on insurance database. They also told me that they would like to compensate me for the hussle - £55 by cheque.
    What do you think I should do / not do next?

    Accept the cheque and chase your data subject access request up.

    They have 40 calendar days to comply with your request.

    I hope you used recorded signed-for post for your request as then you can report them to the Information Commissioner for non-compliance if you don't receive anything from them after 40 days.

    Though I have been told recently that audio recordings are often kept for a short time. So depending when you asked for your recordings they may have been wiped. They still have to tell you this though.
    I'm not cynical I'm realistic :p

    Thank you, olly300. The chap I spoke yesterday said that they listened to all conversations and agreed that there were wrong. So I am guessing they might still have recordings.

    I did not send my last letter (requesting transcripts in writing) by RD. Shame!

    Update:

    I received a letter of apologies and a cheque for £75 (I must have misheard the amount before). No transcript of conversations. I wrote them a note asking for the transcript again.

    Now bad news: I got a letter from Allianz of findings of their investigation. It appears from the letter, that I filled in 6 quote comparisons and was inconsistent about my address and accidents!

    Lesson learned! A glass of wine and browsing insurance quotes is not a winning combination! Moneysaving should be taken seriously.

    If this is correct (about you "misleading them"), then them voiding the policy is going to remain "on record" and have to be declared should you ever want to leave SW!

    So still definitely worth pursuing SW to get your name cleared by Allianz.

    When you do quotes on line, you normally do have to state the info given is correct, and if you have played around with different "profiles" it can come and bite you back!

    Best to use "anonymous" virtual details whilst you "play", then insert real ones only when you are ready to buy.

    Yes, the letter from Allianz read that I need to tick 'have you been refused policy/ has your policy been voided' box from now on. Do I need to do this forever now, or is there a time cap?
