    ok so in future if pressed upon my disciplinary history and asked a direct question such as 'can you please tell us about your disciplinary record' i can respond with 'the one and only official disciplinary warning i have received occurred on xxxx'

    yes. But if the interviewer has anything about them they'll ask a follow up question on pendings as that is a very precise way to word it. You may want to craft in a bit more subtlety.

    Why would they be saying anything in court, they did not give you the job.

    thats fine but actually what if you are asked question by an interviewer and you have no knowledge of whats on your file and you have never been told that things have gone on there - can you be branded a liar for not acknwledgin that which you have no knowledge of???

    And try not getting into this position in the first place. really if you put as much effort into not doing what you did as you are into trying to be devious and kniving and wriggling out and finding pedantic ways in which you can be proved right then you really would have a better chance of a career.

    there were 2 incidents that occurred

    the first was the drink throwing one which i got a written warning for. i actually told them about this.

    the second didn't actually get anywhere! in that i left before an investigation took place, which is my mitigation for not being clear with them in when they asked if there was anything else apart from the drink throwing incident.

    plus my file may contain other bits and pieces, which i certainly have no knowledge of - how can i be accused of lying when i don't know whats on my file????

    yes, im talking about other things which i believe were disclosed that were on my file.
