Thanks Di, l did email CEO of HSBC but as yet no response, do you think l should wait a couple of days or email my adjuicator again ? Dont want to seem impatient but this has been with FOS for over 14 months and l am getting very little response from anyone.
The only thing that stops me getting dishearted is reading this forum and the good advice from you guys and peoples amazing victorys.

    Hi KIMY

I must admit, I am not the one for patience to be honest :o, so with me I would be keeping on at them until I hear something, 14 months is a long time and you have had the patience of a saint.;)

You do what you feel is right for you hon, and there is no harm in contacting your Adjudicator for updates, good luck to you x:A

Thanks Di, to be honest l am certainly not the most patient person and l am starting to loss my patients, really would not mind if either HFC or adjuicator bothered to up date me but HFC ignores everything and the adjuicator just states " HFC are not responding to anything l send them". I think l will send my adjuicator another email stating my concerns of lack of response from HFC. Can you advise if HFC dont respond to her or me what can the adjuicator do ?

    Hi

Well you have been patient so far KIMY.

From my own experience the Adjudicator normally gives them a timescale and if it's ignored in that time, they forward the complaint on to the ombudsman.
I would though ask the Adjudicator about this to make sure though, give her or him a ring if you can, this have gone on far too long now x

KIMY please remind me, have this been upheld by the Adjudicator and agreed by HFC as well? thanks.

Hi Di, too be honest l dont know my adjuicator advised me she has sent everything to HFC and still has had no response, so l dont know if this has been upheld by the adjuicator. When the adjuicator first got my case 2 months ago she called me and said because HFC would not release any documents when l requested a SAR and l had given her a date when l spoke to one of there Customer Services and with the account number he had advised all details where on screen and then when SAR was requested they stated because it was just over 6 years they had been destroyed. My arguement was they have all details on microfiche but refusing to release. My adjuicator told me not to worry because as she knew exactly how much l borrowed and when l paid back she would do some groundwork based on old accounts with HFC and work out what she belived l was due back. The loan was for £15k and all frontloaded PPI l did pay back within 2 years and only rebated small amount of PPI paid. I never denied signing for PPI but only because was told that loan would not be approved, and me and my husband had a job with full sickpay, healthcare and excellent redunandcy package.
Sorry to be so long winded but wanted to fill you in on some history and get your valued opinion.

Hi Di, thought l would bring you up to-date, to be honest still no further forward. I could not contact my adjuicator so l decided to call HFC l spoke to a lady who said they had just sent another letter out to me yesterday advising me they are still investigating l could help myself and l said to her "are you taking mickey you have had this claim since April 2010 and its been with an adjuicator since April 2011 and you have responded to any of us". She was very apoligetic and when l stated l was told l would have a descision by 31st August she said "yes" l then said to her if you cant reach a descision within 15 months but you are now saying you will within 15 days. To be honest l dont think l am going to get any where its been with them 15 months and with adjuicator since April and l am getting no further forward.

    Hi KIMY

Sorry for not getting back any earlier.

    You are very welcome.;)

In my opinion its a good case you have here and I am surprised it's taken as long as it has done, that's awful!

I know they MUST keep to the deadline date as a rule by the FSA, but still why you have waited this long it beats me.

You could contact/ring the FSA about this, to what I know of someone else did this and they contacted the bank (can't remember which one) and the case was sorted.

Hi Di, after speaking to HFC l decided to email my adjuicator, l asked her why in 4 months since its been with her and she has not had one return of communication from HFC what was the way forward if they did not communicate before 31st August. I know l am going on a bit but this is so frustrating with really lack of communication from both sides. I know the FOS adjuicators are extremely busy but maybe they should be acting with more speed when company does not corresspond within 4 months and blatanly ignore you.
I guess l will have to wait to 31st August to find out if l hear anything.
    Keep you updated.

Update for Di, received a email from adjuicator yesterday stating she has had corresspondence from HFC stating they cannot locate records on any of my accounts?
Decided to contact HFC and was told letter in post still investigating (now since March 2010) and they hope to have a answer by 31/08.
Last night going through all paperwork and noticed last letter from HFC stating still investigating one of the account numbers incorrect, so l checked all correspondence and they have been correct. The ironic thing is one account which was a Dixons card which was not paid off until 2006 was listed by them and l know did not have PPI as there CS advised me they say have no record of this and this is within six year timescale and not obviously claiming against. To be honest CEO not responding to any emails the adjuicator not responsive at all and my husband had enougth of listen to me.
    Can you advise Di ?:o

I ended up sending an e-mail to the CEO of HFC every few hours from work for a few days and in the end i did get a reply. Don't give up hope as i'm sure it will be dealt with soon. I would keep sending the same e-mail to the CEO and after a while you will get an answer. Good Luck.

    Hi
Thanks for the update, and fingers crossed for the end of this month.

In regards of the other matter, you could contact the FSA by ringing them, or email the CEO again and make it clear you will be doing this as you are not happy and feel badly let down by a business you used to trust.

Have you a good local MP that may be able to help you with this on your behalf perhaps?:)
