See this is what I'm thinking, but if I try and cancel the transaction I will definitely get a negative, or I risk sending it and losing the money and still getting the negative.0 -
Hopefully ebay will check out the bad FB he's given to most of the other sellers he's used & cancel the transaction.0

Nope, no support from ebay, been told to cancel the transaction as a mutual agreement, and feedback, by both parties, can still be left as long as it's honest and fair.0

If you do send it make sure you take a photo or write down the IMEI number as well - then if he claims it's faulty and sends you back a different phone, you can prove it0

You have entered into a contract. Send the phone signed for, that gives your proof of delivery. If its faulty he can return it or make a claim but for what reason? I use eBay a lot and have incurred this problem once, I asked the buyer to return goods and they went away.0

Whilst I do feel for the OPs dilemna I cannot see how a neg along the lines of 'seller refused to sell' could be challenged as unfair, as it would be the truth.
