Asda have thrown my car keys away.

I agree in principle - but there are extenuating circumstances here. Asda had the keys in their possession, and they had several opportunities to reunite them with the owner but failed to follow their own procedures. As such it is reasonable to say Asda failed in their duty of care.0

I'd be interested to know what date the keys were put into the book. We only keep things for a maximum of 2 weeks and after that they're destroyed.0

Could ASDA not argue that their lost policy procedure is part of their internal policies, and failing this is an internal matter and does not form a contract to act as a bailee with the owner? And any signs stating 'they are not responsible for loss or damage of personal property' deminishes their responsibility as a bailee also?0

I don't have a master key hence why so expensive.

Yes it's my fault they were lost in first place.
But I left details of keys, my name and number and went in asking weekly. I also had friends who work there asking too?
What more could I have done.
I'm annoyed that they were sat there the whole time.
No one ever mentioned or looked in the found book so I didn't know it existed?
I'm not sure why they write details in a lost property book and then any found items in a found book if they don't bother to connect the two??
Why take details if they have no intention of reading them when items are found?
The manager said they don't bother as it's hard to tally the two together? Surely that's the point??
So how many other peoples items have they found and thrown away - while the customer is waiting for a call as they left all their details??
They were found on 25th may - so only 12 days after I lost them.0 -

The master key will normally have a plastic tag on it with the coding information (normally being on Honda, Ford and VAG cars that are in the family)0

Interesting you say it was 18 posts long. That must mean that 2 peoples posts have been deleted as mine is showing as post #16. You can't really count post #1 either as that's the kick starter & all the feedback comes afterwards, so technically only 15 posts now.This thread was only 18 posts long before you chose not to read it all...thankfully there are still helpful people on MSE who will manage to do so before commenting.
But still, i read enough & had enough of what i was reading. Members looking down on other members, preaching off their high horse. There really is no need for it.
I'm not saying we should be nicey-nice to people & walk on eggshells all the time, but SOME people really do catch a serious unnecessary attitude on here at times. Who made these members so superior anyway?

I'm well aware that at that point nobody had really addressed the rights issue from what i had read. This is likely down to the fact that people were too busy snorting "you should take better care in future now shouldn't you". The only problem here is op has come on to this board, explained his situation and wanting to know what rights he has. Thus far nobody has been able to determine whether he has or not. Because ASDA haven't put him at a loss, but he has.
In your example, you got a full refund -- this doesn't necessarily mean you had a RIGHT to a refund. It just means they chose to refund you in this instance.
I agree with you that i may not have had a right to a refund, but i got one & this is the point i was trying to make to OP.
If they just listen to certain people on here saying "har har, you got what you deserve" then they'll obviously get nothing.
If they take it further - store manager, head office etc, then they MAY get something.
Nobody ever gets anything if they don't ask for it.0 -
Well the description of the keys found matched my description of them - large bunch of keys, telco fob, tinkerbell in a flower key ring- this was only bought 4 weeks before on holiday in California so easy to distinguish.
And no body has signed to say they collected the keys so yes they were my lost keys!!
A lady rang earlier asking for a full description of keys. Says she was acting for the manager who obviously can't be bothered to speak to me himself.
And I complained about a certain poster so they must have been banned - satisfaction

When she took the full description of the keys what else did she say?Thinking critically since 1996....0
