My response will be along the lines of please refer to your on site terms and conditions in particular:

1.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Once the Supplier does so, there is a binding legal contract between us.

At no time have I been consulted with nor consented too the cancellation of OUR contract please re-instate my order immediately.

The above seems to happen more and more frequent now, there's always some idiots who decide to ring the company up to either tell them or ask if it's for real.

For what it's worth, I think they must be retards for entering into a contract they are likely to lose a lot of money over. Instead of slagging people off, why not read up on contract law, and unfair contract terms (ie having a term that enables you to alter the price AFTER the formation of the contract) and come back then

Also, even if the misprice term was held to be legal, they have breached it by not giving us 14 days to decide if we want to purchase the goods at full price or cancel the order.

If everyone messes them about and continues to respond to every reply by them for a week or two it'll slow them done.

I know some of the members will disagree but ebuyer are notorious for this. They make the same mistake time and time again and flout the laws of contract. Look at it this way - if you over paid because they made a mistake in their favour, do you think they'd inform you.

At least if all the consumers mess them about they'll realise how costly these mistakes are and put in place proper and reliable safeguards so they don't mess up again.

(and of course if you really want to mess them about you could consider a small claims courst claim - you can even start it online)
