Do the Banks pay up by cheque or not?

Hi,
I am in the final stages of a claim with BARCLAYS BANK. I have claims submitted against two accounts with the WOOLWICH. They have offered me settlement figures of £1000 (account closed) and £3160 (Account still open) respectively for the two claims.
They insist that the payments, if accepted, would be paid by cheque for the closed account and credited to the still open account.
My difficulty is that when I incurred all of these charges I was in a little bit of financial difficulty which I have now clawed my way back from.
The account which is still open has a debit of approximately £2000 which is being taken care of on my behalf by the CCCS by way of regular monthly payments. If I decide to accept there offer for £3160 they insist it must be paid into the account, I would prefer a cheque as I have much bigger priorities to consider by way of outstanding debt etc.
CAN ANYONE ADVISE ME IF I CAN INSIST ON PAYMENT BY CHEQUE OR DO I HAVE TO ACCEPT THEIR WORD THAT IT GOES IN TO THE ACCOUNT?

You can always write to them and ask them, but don't hold your breathe.
If you think about it though, they are quite within their rights to pay the money into the account it's being claimed from. If they refuse all you can really do is tick off your overdraft as paid, or alternatively if the overdraft is still active use the money to pay off your other debts.
Presumably the bank didn't make your refund conditional that you pay off your overdraft did they? If not then you are free to go into your overdraft to pay anything you like off.Hamsters have no tact and diplomacy, nor do they want any.0 -

You can't insist unless it was part of the settlement. The bank is free to pay you in any legitimate way it likes.Hamsters have no tact and diplomacy, nor do they want any.0 -
Hi there, can anyone advise me on this? I sucessfully got my bank charges reclaimed( £840, they didn't go for the interest i added lol, but better than nothing).
Anyway they have written to me to say they will debit my account with the sum, the problem is, that is an old account that i no longer use but is overdrawn by £2500, i am paying it off by dd bit by bit each month.
What i want to know is can i write to them or call them and ask for it to be paid to me by cheque or into my other account (both Barclays)? As by paying it into the O/D acc i'm still not in affect benefitting, yes i no it'll help to pay towards the O/D but i don't want to use it to just be swallowed up.
C an i ask either of the other options?

phoned first direct to see where my cheque was and they said they canpay the money into another bank account of my choice!!

After years of problems with First Direct, I decided to leave and get a new account. I need help from a debt mangament company and they told me to leave the overdraft at it's limit of £750 as i could not afford to pay it back. I have now reclaimed my bank charges and have been offered £1385. Which they cannot give my by cheque and mustbe paid directly into my old account and i can take the difference. Are they within there rights to do this. Any help would be very much appreicated.0

Yes they are within their rights to do that, in that they are legally attempting to recoup their losses.
Unless you negotiated a settlement which included the provision for paying you via cheque of course...Hamsters have no tact and diplomacy, nor do they want any.0 -
Ok, thanks for that. Bit obviously really, but just annoying that the first time in a while i get my hands on some spare cash and i have to pay it back. Oh well my fault it the first place i guess!!0

If successful with my claim, how am I likely to be paid back? Do they just credit it to my account (assuming they don't close it that is!) or do they send a cheque.
Will try to set up a parachute account but am a bit worried as have no bills in my name where I live. If they credit my account I can write my girlfriend a cheque that she can put in her account and then she'll give me the money. If they send me a cheque, I'm a bit stuck.
