Bank gave me too much money...

  • Reading though the various replies.....
    You say you came on to the forum for help.....but really, what help/advice can we give. The issue is simple: You owe the money back.

    If you were thinking that we are going to help you find ways to avoid you paying back the money at all - then sorry but MSE is not the forum for you.

    Im not really getting anywhere now am i.

    Talking to friends and family, they said, what are you going to do. I obviosuly said " i have no idea" First port of call is the internet. First website i came across was this, with a forum - brilliant, lets see what these guys have to say......

    I definitely don't think you're lying. But you can't deny it does seem odd you'd forgotten about £1400 that you took out and spent (hence the connotations that you're lying). But it happens, I've seen it very genuinely. I wouldn't worry too much, it'll be fine. I would, however, ensure you have a new account set up with a completely unrelated financial body.
    Unfortunately the only help we can offer is what's already been said. You'll have to agree a repayment plan, a parachute account is probably wise, and by all means make a complaint.

  • Just offer them a method of repayment.

    In my mind they do have some fault lying with them, I too would expect them to check that there are enough funds in the savings account to cover any withdrawal - that's common sense.

    So if you offer them a method of repaying it, I'm sure they'll accept and the cashier in question will have had their proverbial wrist slapped.

    Given that the savings account won't be reporting to any credit reference agencies I have my doubts whether it will effect your credit record so you may be alright on that score.

    Of course they can just dive into your bank account to take any money in there, right of set off and all that.

    I think you need to discuss a payment plan with them -that's the first step.
    After that-personally I'd open a current account elsewhere
    I'd also expect the bank to take on some accountability regarding their negligent cashier-an apology for one-and some consideration over time to repay for another.
    If you cannot reach any common ground then put in a official complaint (something I imagine the branch won't want as it makes them look dreadful and they'd rather it was settled at branch level) and if you still don't get a managable repayment plan then take it to the banking ombudsman.

    However as this is Santander who are way down the list on the complaints league table (something MY bank mentioned when I commented on how quick their (NatWest's) complaints dept were at admitting a gross error was made by their fraud dept this week) you may end up having to take it all the way.

    No, it's Barclays. I've just been using Santander for examples as I know their procedures much better.

    There is no magic bullet that will prevent you having to repay the money you now owe the bank.

    You have a case to complain to the bank for the cashiers lack of attention, and you may be entitled to some compensation for that, although I think it would be a token small amount.

    You need to agree the best repayment terms with the bank and then stick to the payments so that your credit record is not adversely effected.

    But you also need to accept some responsibility, savings accounts do not normally allow direct debits or standing orders to be set-up, so didnt you personally transfer the £1400 out some time in the recent past ?
    You could have avoided all the hasle if you had simply asked for a balance check before asking to withdraw money that was not in the account, learn from the experience and move on.

    To be honest you've got to be really stupid to save up for a car and then forget that you've made some transactions when you come to draw out the money. I'm assuming the transactions were made recently, because the cashier would have told you that you didn't have enough money in there, but if they were recently, they wouldn't necessarily have shown up on the computer.

    Anyway, it's your fault. You're in the wrong, not the cashier.

    The cashier should still have checked the balance before giving the money, so there is wrong on both sides, although I am struggling to believe that OP just "forgot" about spending £1400, especially as they were saving for a car. The money will have to be paid back, there is nothing more that anyone here can advise, so Im not sure what OP ws expecting us to say.
    Debt free and staying that way! :beer:
