    Anyway I looked here http://
    • Are faulty or not of satisfactory quality; or
    • Are not fit for the purpose for which they were sold; or
    • Do not correspond with their description or price indication; or
    • Do not correspond with the sample on display
    AND
    • Are returned within a reasonable time; and
    • Are accompanied by a valid receipt or other proof of purchase
If goods are returned for any other reason, refunds or exchanges will be at the discretion of the store manager, however, please note that customers are not entitled to a refund if:
    • they have simply changed their mind; or
    • they have damaged the goods after they have purchased them; or
    • they were aware of any defect prior to purchase.
This does not affect customers’ rights under the Sale of Goods Act 1979.

Basically the clothes and shoes were returned because they weren't fit for purpose (due to being too small) they were taken back within a reasonable time, 1 day!, and she did have a valid receipt. So they can't refuse her a refund surely?

    They ARE fit for purpose.

Your complaint is that they don't fit. She should have tried them on. If I buy something for someone else (eg a top from Republic's sale for my 17 YO son, which I did last week) I ask, at the point of sale, if I can bring it back because I am buying it for my son and he's not with me. If they said no I wouldn't buy it.

So they CAN refuse a refund. They are not faulty.

You're forgetting that if you simply change your mind YOU ARE entitled to a full refund with 28 days EVERYONE has that right and I guarantee I will get those items refunded tomorrow.

    You poor misguided fool.

Some stores CHOOSE to give customers a 'change of mind' get out. It's not enshrined in law. Some stores will not refund in full, in cash, but will offer an exchange note, valid for a limited time.

Anyway, looks like the OP didn't get his refund.

e shoes although they stated they're a size 6 didn't fit, they were only equivalent to a size 4.
It therefore looks as though the sizing was American as Size 6 US is normally equal to size 4 UK. No misdescription there. I wonder if it gives a European size of 37 or 39 in them

I bought some curtains from TJ's on Saturday, got them home, they didnt meet my expectations and I want to return them tomorrow. Having checked my reciept it does clearly say on the bottom:

"on 30th June 2011, Thomas Andrew Jack and Simopn Allport were appointed as joint Administrators of TJ Hughes Limited (the company). The affairs, business and property of the company are being managed by the joint administrators who contract as agents of the company only and without personal liability"

"Please note that following the appointment of administrators, revised policies regarding customer returns, refunds, exchanges, & deposits were implemented with immediate effect. please see the notice to the customers displayed in store for further details. please note these policies over-ride any other similar policies in effect prior to the appointment of administrators, including any stated on the reverse of your receipt."

Despite not being advised this at the time of purchase, and I failed to see any signage around the store for all the bargain-hunters and mess around I guess sadly it does make sense, and Im hoping they will offer me an exchange tomorrow. If not Ebay will be my Plan B!

    Will keep you posted!

You might be in the Customer Service queue a while - it seems Soniclord has been there since Saturday arguing his/her case :rotfl::rotfl:

This is correct information. The OP hasn't a leg to stand on legally, bar rely on the goodwill of the store. In this case, the store is saying 'no'. Consider this a lesson in consumer law, or rather the OPs lack of understanding.

Of course, if you had purchased them online, you would be fully within your rights for a refund.

Fudge the goodwill of the store lol, the store had NO CHOICE in refunding me and I waited in store for half an hour as they knew I wasn't leaving without my refund, so they phoned 1 of the administrators who had to authorise everything and I had to wait half an hour for him to get to the store..

Anyway after explaining everything and how long i'd been waiting, what I'd been told on the phone etc I did indeed get my refund!

Well, I'm all lined up, popcorn at the ready.

Did the OP get a full refund today, or not?

Did you enjoy your popcorn? Yes I did get my refund
My money's on no .......after all we were assured that, armed with reams of paper detailing his rights under the SOGA act, TG Hughes would crumble and he would have great joy in proving us all wrong.

So can we can we call him kermit or fozzie bear now?

It's TJ Hughes not TG Hughes.. And your money is now lost as you said your money was on no lol.

I miss the OP. I was expecting the good news by now

See my replies to others above. And I hadn't been back as I was spending my refund money elsewhere.

    P.S) I missed you to ;) lol

Not misguided actually, more gifted! I got my refund and I couldn't give a flying fudge on what is and isn't enshrined in law. I know I got my refund and that's good enough for me.

Licking something ;) but not my wounds! Oh go on then I'll tell you it was a big FAT lolly out the freezer.

I would not have expected Soniclord to post back anything other than a good result. It is horrible to lose face even on the internet and pretending they were right and 'won' is easier than admitting they had no clue about their rights after all.

I hope you find someone else that the shoes fit, good luck.

Excellent post to start the day. I'm just trying to imagine why an administrator dealing with liquidating a business would personally travel 30 mins to attend the store to authorise Soniclords refund :rotfl::rotfl:
  • Just because you were difficult and awkward in store (like you have been on these boards) does not make it your consumer right to get a refund. They gave you it just to shut you up no doubt. :D

Well done on achieving your dream.
