....Because why should she need to buy a size 2 or 3 times bigger than what she is just so they fit?

Because womans clothes vary so much size wise, she liked them enough to buy them in the first place. Is the size more important to her than how the clothing looks? She was happy enough to buy bigger shoes than normal.

Is it a case of buyers remorse perhaps?

    From your original post...

If goods are returned for any other reason, refunds or exchanges will be at the discretion of the store manager, however, please note that customers are not entitled to a refund if:
    • they have simply changed their mind; or
    • they have damaged the goods after they have purchased them; or
    • they were aware of any defect prior to purchase.]/quote]

But they'd then have to prove they were damaged after purchase, it's only been 1 day since they were purchased and the potential 'fault' wasn't found till later tonight. That's of course if it comes to that. Which it won't. A refund will be given based on at the very least what the receipt says. Thanks for your replies.
tbh I am fully expecting you to come back and say you got a refund - god forbid you would come back here and post that you didn't because the retailer told you (politely) go back and read the SOGA again but this time properly.

I'll tell you this if they didn't refund then I'd say so, and when they do refund I'll gladly come back here and post the receipt proving it.

No it's a case of the clothes aren't as per the description! Size 6 being no bigger than a size 4 and the clothes well.....

Please note that for goods purchased from the date of appointment onwards, we will only give refunds on goods which:
    • Are faulty or not of satisfactory quality; or
    • Are not fit for the purpose for which they were sold; or
    • Do not correspond with their description or price indication
See the part highlighted in BOLD they don't correspond to the description! I.e a size 6 being no bigger than a size 4 and a size 14 let's say being no bigger than a 10-12

As other posters, have said stores do use different sizes from each other - they even do this with men's clothing now (some fashionable shops seem to cater to the view that a normal fit xxl shirt should fit a guy who is as skinny as a rake, rather than average build) - it is the responsibility of the person buying to at least try to check if they will fit. In offering an exchange the store is doing more than they have to.

By what standard have you determined that the shoe is not a size 6?

Note: just saying "it's the same size as another shoe marked size 4" is not accurate, unless you have first determined that the size 4 shoe is correct.

No you're not. Many stores do it as a guesture of goodwill - its not a right - please chek your facts before you make an !!! of yourself.

This is correct information. The OP hasn't a leg to stand on legally, bar rely on the goodwill of the store. In this case, the store is saying 'no'. Consider this a lesson in consumer law, or rather the OPs lack of understanding.

Of course, if you had purchased them online, you would be fully within your rights for a refund.

My money's on no .......after all we were assured that, armed with reams of paper detailinghis rights under the SOGA act, TG Hughes would crumble and he would have great joy in proving us all wrong.

So can we can we call him kermit or fozzie bear now?
