Emplyee off sick but I think it is not true

I bet if you went off with stress (not that i'm implying you should) your manager would have to do something then. But it's all what ifs.
Here's one....
I don't know the legal ins and outs of it, so hopefully others could clarify, but how about changing the contracts?
This bit stuck out like a sore thumb to me:
At our place, we don't have a choice.
Our contract basically says:
* we will work overtime as and when required.
* in some departments, saturday is part of the working week which will be worked on a rota system
* if others are ill, you may be asked to cover periods of sickness which you wouldn't normally work
So to spell it out:
i SHOULD'VE been having next Saturday off, but i can't because 2 people have gone sick - so i've been told i have to work. Yes this is a weeks notice, but i've been given days notice before. The least notice i was given was 1:30hrs notice before i finished on the Friday that i had to work on the Saturday the following day.
So couldn't the contracts be changed so that these other people would have to come in in times like this?
You are tottaly right here, but if I ring someone to ask to come and cover and if they tell me they are not home or they have plans, then there isn't much I can do. Yes, the contract does says that they are required to do extra if needed, but I cannot drag them to work, so I am a bit stuck on that.
Same here, I shoud've been off tomorrow, instead i am working 12h, i might only work 8 h on monday, or 8h, 8 h rest and 16 h shift!0 -

Whilst it is legal for companies to call employees ' to inquire after them aka 'courtesy call' they cannot demand that the employee returns to work. Given that she states her Dr has advised her to take the weekend off, ie 48hrs or so for a bug to go through the system she has clearly advised you of when she is expected to return to work. Given you had these facts I fail to understand why you felt the need to call her, likely upsetting her son in the process, unless it was to 'persuade' her to come into work, and she would be within her rights to raise a grievance for this.
To me the real issue is that a member of your staff phones in sick and has been advised by a Dr not to go to work and this leaves you to cover which you seem clearly unhappy about, unfortunately this seems to come with the territory as your responsibility as a manager and an expected part of your job. You have no proof that she is attending the theatre this evening only the knowledge that it was her intention. Unless you have irrevocable proof that she is pulling the wool over your eyes then the quote above pretty much sums up going forwardDont wait for your boat to come in 'Swim out and meet the bloody thing'

Get your boss to do it - he's treating you as a doormat. Start making yourself unavailable.Don’t be a can’t, be a can.0 -
If your location didn't say Kent, i'd think you were from the same training school as me
Does the book say that it is YOUR ROLE to chase up people on the sick?
Yes/no?
If yes then you need to research what you can and can't do, can and can't say. You need to cover your behind at ALL times as if you don't, you'll be had with anyone who has a bit of intelligence.
However, if the answer is no, then stop!!!! Do your job & let other people do theirs.
I've only rang her once, and I don't usually bother people in their time off unless is to get cover, so give me some rest!0 -
No i have not been trained at all to do my job despide many requests from my side! I can only do what I think it's right and try to follow the book!
Ok. Well what you did earlier is not right.
For the sickness absence management, there will be a procedure to follow. This includes the procedure that the employee has to follow for calling in sick, as well as the management of sickness and back to work interviews.
For the management of staff, you need to consult with HR on the situation of your staff member and their comments re: how to play that one out.
For the management of the team when x amount of people call in, you need a process drawn up with your manager for each case scenario; ie what to do when one person/two people/three people are not in work - ie you cannot take up all the slack and he needs to work with you on making sure that hours are covered in situations like this. If he doesn't, then you have to tell him that you are not covering these hours and he need to decide how that is going to be done. If he is not responding to you, you need to speak to HR about what you need to do in order to sort this out.If you haven't got it - please don't flaunt it. TIA.0 -

I'm with you. I get the impression that most on here have absolutely no idea of how difficult it is to keep a small business going. If they had their way any company with only a few employees would go to the wall under a pile of regulations on what you can and cannot do. In the end Tesco would probably be the only employer left.0 -

Fortunately, I am in pretty good health, I've been off sick for 2 days in 5 years, so I should be ok. I don't know what will happen if something unexpected happens and I cannot do it
, probably he'll get one of my team members to work a silly shift? 0
