ppi claim

hi. new to site and just wanted some advice. Back in 2000/2001 got into financial difficulties, struggling to pay Visa credit card and M& S loan, so contacted CAB for advice, they arranged for lower payments, this still in progress, so my question is this, can I still make claim to recover PPI although I defaulted on both? Any advice would be helpful.

    Hi and welcome

    Yes you are able to, it makes no difference, also if your still paying for this then its now possibly worthless to you anyway as your not going to be able to make a claims as such for unemployment/sickness etc, so if mis sold as well make a reclaim but if not mis sold and when you went into financial difficulties ask them to refund from there, and to cancel the product as well, because its only added to the debt.

    Please be aware though, the refund maybe used towards the debt, anything remaining and interest I understand is awarded directly to you.

    Follow the link below to the questionnaire, you pursue the ones who set up and sold you the account, complete and send to their complaints or head office, keep a copy for yourself as well, and allow 8 weeks for a decision, if they need more time they will let you know.

    Thanks for the information. I'm no longer paying PPI and they eventually stopped the interest and I'm sure they made the insurance null & void due to default. Still going after them for mis-sold. Keeping my fingers crossed and realise if successful this will go towards paying this off. Thanks again.

    Just a suggestion, and it's your choice of course, but have you thought about requesting for a Subject Access Request (SAR), this is a request for all your data and this should hold details of the loans/ppi and so on, and details of the default..

    If you decide to do this, then you send the SAR template letter (there is a full one below) to the data dept of the company who sold you the loans accounts etc, they have 40 calendar days to comply, but there is a one off payment you enclose with this with is £10 cheque or postal order.

    Hi, Just found paperwork for loan from m&s and on their quote which I have signed, there is details of insurance, but I believe at time taken, I was advised to take insurance in order to get loan, and if I remember rightly, had loan with them with insurance and took another to pay off this and get another advance. Does the form you are suggesting I request, does this still apply if I have the original paperwork?

    Help please, as per my previous quote, do I use SAR or as I stated previously, if I have loan agreement do I do the £1 letter instead?
    Any help is much appreciated.

    sorry for the delay in responding, just came back to this one now.

    As long as you have details of the loan, that is fine and you can continue to make a reclaim, anything you have in paperwork will be an help.

    If you have the loan agreement then that is fine, you do not need to request for this now, but just for future reference - below -

    If you want to just request for the copy of the agreement, you are correct in saying you enclose £1 cheque or postal order for this request, so basically just write a simple letter, request they send the copy of the agreement by 12 days and make them aware that you have enclosed the payment of £1 for this request.

    However, I will state though, if the account is that of a settled account, they and more than the last 6 years, they may not any longer hold this actual agreement as such, but they have to comply to a SAR if you requested for one of these, this again is optional, and helps if you've no paperwork or info to go on at all.;)

    So if you want to just continue to make a reclaim, on one of my above posts I posted the link to Step 3 which is the reclaim questionnaire, complete and send to the head/complaints office of whoever set up and sold you the account, keep a copy of the completed questionnaire in case you need to go back to this again at some point.
    They normally have 8 weeks to send a decision, but will write to ask for more time if required.

    Hiya & not a problem.

    A SAR is totally optional, you do not have to request for this if you don't want to, basically if you have the signed agreements that confirm PPI, that is fine and you can therefore continue to make a reclaim anyway.

    However, a SAR should provide data going back at least the last 6 years, some hold details for even longer, so this is up to you of course, if you have your reasons, you can just make a reclaim without the need of this data.

    The SAR letter lists what is required.;)

    Just to separate this post to my one above to save confusion, to make a reclaim, you complete the reclaim questionnaire as on step 3 below.

    Send to the main/head office of whoever sold you the account, if they have a separate complaints dept you can send the questionnaire to them, remember to keep a copy in case you need to refer to this again at some point.
